THE REGIONAL MUNICIPALITY OF PEEL

BY-LAW NUMBER 89-90

A by-law to stop-up, offer for sale, sell and convey part of the public highway located in Part of the West Halves of Lots 10 and 11, Concession 3, in the Town of Caledon (formerly Township of Albion), Regional Municipality of Peel.

WHEREAS the Council of the Regional Corporation has by Resolution Number 90-347-6 on the 13th September, 1990, authorized the stopping-up, offering for sale, selling and conveying of portions of land being part of the Public Highway located in Part of the West Halves of Lots 10 and 11, Concession 3, Town of Caledon (formerly Township of Albion), Regional Municipality of Peel, which are not required for municipal purposes and which lands are more particularly described in the Schedule hereto attached and marked Schedule "A";

AND WHEREAS notice of this proposed by-law to stop- up, offer for sale, sell and convey the lands has been published in the Caledon Citizen having a general circulation in the Town of Caledon once a week for four successive weeks, namely on the 24th of October, 31st of October, 7th of November and the 14th of November, 1990;

AND WHEREAS the procedures taken for publishing the said notices pursuant to the provisions of the Municipal Act are set out in the Affidavit of Deborah E. Trouten, Regional Clerk and Director of Administration of the Regional Corporation, which is attached hereto and marked Schedule "B";

AND WHEREAS the Council of the Regional Corporation has afforded an opportunity to any person claiming that his land would be prejudicially affected by this by-law and who applied to be heard in person or by his Counsel, Solicitor, or Agent, but no such person applied to be heard;

AND WHEREAS the owners of the abutting lands have the right to purchase the soil and freehold at a price to be fixed by the Council of the Regional Corporation;

NOW THEREFORE the Council of the Regional Corporation enacts as follows:

1. That the parts of highway described in Schedule "A" attached hereto be and the same are hereby stopped-up, closed and deprived of their character as a public highway or street.

2. That the Regional Solicitor and Regional Clerk and Director of Administration are hereby authorized to execute all documentation required in connection with this matter.

AFFIDAVIT

 

I, Deborah E. Trouten, of the City of Mississauga, Regional Municipality of Peel, make oath and say as follows:

1. I am the Regional Clerk and Director of Administration of the Regional Municipality of Peel, and as such have knowledge of the facts contained herein;

2. That the Notice of the proposed by-law to stop-up, offer for sale, sell and convey the lands described in Schedule "A" of the By-Law Number 89-90, was published in the Caledon Citizen on the 24th of October, 31st of October, 7th of November, and 14th of November, 1990.

3. That the proposed by-law came before the Council of the Regional Corporation for the Third Reading on the 22nd of November, 1990 and no one filed written objection to the proposed by-law and no one appeared in person or by counsel to make representation with respect to the proposed by-law, and as a result the Council gave By-law Number 89-90 third reading.
