THE REGIONAL MUNICIPALITY OF PEEL

BY-LAW NUMBER 36-91

A by-law to adopt estimates of all sums required during the year 1991 for the purposes of the Regional Corporation and to provide a levy on Area Municipalities.

WHEREAS the Regional Corporation is required by Subsection 1 of Section 84 of the Regional Municipality of Peel Act, R.S.O., 1980, Chapter 440, as amended (hereinafter referred to as "the Act") to adopt yearly estimates of all sums required during the year for the purposes of the Regional Corporation, including the sums required by law to be provided by the Regional Council for any local boards of the Regional Corporation;

AND WHEREAS Subsection 1 of Section 85 of the Act in part provides that the Council of the Regional Corporation in each year shall levy against the Area Municipalities a sum sufficient for payment of the estimated current annual expenditures as adopted, and for payment of all sums required to be raised for sinking funds and principal and interest payments or sinking fund requirements in respect of debenture debt of Area Municipalities for the payment of which the Regional Corporation is liable under the Act;

AND WHEREAS Subsection 2 and Subsection 3 of Section 85 of the Act in part provide that the Council of the Regional Corporation shall ascertain and by by-law direct what portion of the aforesaid sum shall be levied against and in each Area Municipality, and that all amounts so levied shall be apportioned among the Area Municipalities in the proportion that the whole rateable property in each Area Municipality bears to the whole rateable property in the Regional Area according to the last revised assessment rolls;

AND WHEREAS a Per Household Grant payment pursuant to The Ontario Unconditional Grants Act, R.S.O. 1980, Chapter 359, as amended, is to be made to the Regional Corporation in the year 1991 and is to be credited to the Area Municipalities in the sum of eighteen million, eight hundred and twenty-three thousand, seven hundred and twenty-nine dollars, ($18,823,729.00);

AND WHEREAS a net Policing Grant Payment is to be credited to the Town of Caledon in the amount of one million, two hundred and ten thousand, one hundred and twenty-four dollars, ($1,210,124.00);

AND WHEREAS a net grant is to be credited to the City of Brampton in the amount of two hundred and forty-one thousand, nine hundred and ninety-four dollars, ($241,994.00) for solid waste disposal purposes;

AND WHEREAS the Council of the Regional Corporation has adopted By-law Number 11-91 which enacted an Interim Levy against the Area Municipalities in the year 1991;

AND WHEREAS the Council of the Regional Corporation has approved by resolution on April 25th, 1991 and authorized the enactment of a by-law for the collection of levies against the Area Municipalities for general purposes;

NOW THEREFORE the Council of the Regional Corporation enacts as follows:

1. That the sum of one hundred and seventy-six million, five hundred and ninety three thousand, two hundred and thirty-four dollars, ($176,593,234.00) be levied against the Area Municipalities and that the Area Municipalities do pay the following apportionment of that total;

2. That the Per Household Grant; the gross Policing Grant and gross Solid Waste Grant totalling twenty-five million, six hundred and eighty-seven thousand, five hundred and seventy-eight dollars, ($25,687,578.00) be credited as follows:

3. That the net levy against each Area Municipality totalling one hundred and fifty million, nine hundred and five thousand, six hundred and fifty six dollars, ($150,905,656.00) shall be as follows:

4. That the Area Municipalities shall be entitled to deduct from the levies in paragraph 3 those monies, excluding interest, previously billed on the Interim Levy pursuant to By-law Number 11-91 of the Regional Corporation as follows:

And that any amounts not received by the Region's bank via electronic funds transfer by the due date, or by the Regional Corporation before the close of business on the due date, that being 4:30 p.m., to allow the Region to receive value for the funds on that day, shall bear interest at a rate equivalent to the lesser of the highest chartered bank prime rate on the day plus 1 1/2 percent per annum and 15 percent per annum, from the date payment is due until it is made.

6. That the Treasurer and Commissioner of Finance is hereby directed and authorized to do all acts necessary to collect these levies.
