THE REGIONAL MUNICIPALITY OF PEEL

BY-LAW NUMBER 55-91

A by-law to permit Retail Business Establishments located in the Mississauga Chinese Centre, 880 Dundas Street East, Mississauga, Ontario to be open on any holiday pursuant to subsection 4(1) of the Retail Business Holidays Act, R.S.O., 1980, chapter 453, as amended.

WHEREAS an application has been made by Mississauga Chinese Centre Limited for a by-law under subsection 4(1) of the Retail Business Holidays Act to permit the retail businesses located at the Mississauga Chinese Centre at 880 Dundas Street East in the City of Mississauga to be open on any holiday;

AND WHEREAS under subsection 4(2) of the Retail Business Holidays Act, the Council of the Regional Corporation held a public meeting on the 4th June, 1991 in respect of the proposed by-law and did publish notice of the public meeting in the Mississauga News being a newspaper having a general circulation in the City of Mississauga on the 1st May, 1991, and did publish notice of the public meeting in the Toronto Star being a newspaper having a general circulation in the Region of Peel on the 2nd May, 1991;

AND WHEREAS at the aforesaid public meeting, all persons who attended were given the opportunity to make representations in respect of the proposed by-law;

AND WHEREAS the Council of the Regional Corporation has determined that it is appropriate to enact the proposed by-law for the purpose of maintaining and developing tourism within the Regional Municipality of Peel;

NOW THEREFORE the Council of the Regional Corporation hereby enacts as follows:

1. Notwithstanding section 2 of the Retail Business Holidays Act, and subject to section 2 of this by-law, all persons carrying on retail businesses in a retail business establishment and all those persons employed by or acting on behalf of persons carrying on retail businesses in retail business establishments located upon the lands described in Schedule "A" to this by-law are hereby permitted to sell or offer for sale any goods or services therein by retail and to admit members of the public thereto on any holiday as defined in the Retail Business Holidays Act.

2. Nothing in this by-law or the Retail Business Holidays Act shall limit the opening of the said retail business establishments to any specific times or to a certain number of hours, provided that persons carrying on a retail business in a retail business establishment and persons employed or acting on behalf of such persons shall observe any other validly enacted laws or by-laws regulating the hours during which any such business may be carried on.

LEGAL DESCRIPTION OF THE LAND

FIRSTLY:

All of Lots 14, 17 & 18 and Parts of Lots 13, 15, 16 and Road, Registered Plan G-14, and Parts of Lot 9, Concession 1, S.D.S. designated as Parts 1, 5, 6, 7, 8, 9, 10, and 11, reference Plan 43R-13457, City of Mississauga, Regional Municipality of Peel;

SECONDLY:

part of Lot 9, Concession 1, South of Dundas Street, in the City of Mississauga, in the Regional Municipality of Peel, having an area of 0.778 acre, more or less shown marked yellow on Plan of Survey P-1801-127 and more particularly described as follows:

PREMISING that all bearings herein are astronomic and are referred to the proof line between Lots "A" and 1, run by Unwin, P.L.S. 1877.

COMMENCING at a point, marked by a monument in the south-easterly limit of the King's Highway as widened as shown on a plan deposited in the Registry Office for the Registry Division of the County of Peel as Number 103185 and which said point may be located by starting at the northerly corner of Lot 9, marked by an iron bar;

THENCE South 38 degrees 25 minutes West along the north-westerly limit of Lot 9, a distance of five hundred and forty four point eight seven feet (544.87');

THENCE South 46 degrees 16 minutes East twenty five point nine feet (25.99');

THENCE South 46 degrees 38 minutes East ten point three hundredths feet (10.03') to the point of commencement;

THENCE South 46 degrees 38 minutes East ninety four point nine eight feet (94.98') more or less to an iron bar in a wire fence existing in March 1959;

THENCE South 37 degrees 34 minutes West along the said fence one hundred and thirty four point five six feet (134.56') more or less to an iron bar;

THENCE South 38 degrees 09 minutes West twenty two point fifty feet (22.50') more or less to a monument in a wire fence existing in March 1959;

THENCE South 44 degrees 38 minutes East along the last mentioned fence one hundred and seventeen point ten feet (117.10') more or less to a cut cross on steel plates;

THENCE South 40 degrees 14 minutes 30 seconds West along a wire fence existing in March 1959, a distance of eighty five point eight one feet (85.01') more or less to a monument in a wire fence existing in March, 1959;

THENCE North 46 degrees 29 minutes 30 seconds West along the last mentioned fence two hundred and eleven point eight four feet (211.84') more or less to a monument in the south-easterly limit of the said King's Highway as widened:

THENCE North 38 degrees 35 minutes 30 seconds East along the south-easterly limit one hundred and twelve point three two feet (112.32') more or less to an iron bar;

THENCE North 38 degrees 35 minutes 30 seconds East continuing along the south-easterly limit one hundred and thirty three point nine six feet (133.96') more or less to the point of commencement.
