THE REGIONAL MUNICIPALITY OF PEEL
BY-LAW NUMBER 48-94
A by-law to consolidate the by-laws that regulate traffic on roads under the jurisdiction of the Regional Municipality of Peel, and to repeal By-laws Numbered 92-92, 144-92, 145-92, 146-92, 25-93, 30-93, 41-93, 51-93, 52-93, 54-93, 55-93, 75-93, 84-93, 100-93, 104-93, 12-94 and 15-94.
WHEREAS By-law Number 92-92 of the Regional Corporation is the most recent by-law consolidating the by-laws that regulate traffic on roads under the jurisdiction of the Regional Municipality of Peel (hereinafter called "the Region");
AND WHEREAS amending by-laws have been enacted from time to time by the Council of the Regional Corporation, changing the traffic regulations on the roads under its jurisdiction;
AND WHEREAS in order to obtain greater efficiency in the administration of the traffic regulations on the Region's roads it is deemed expedient to consolidate all traffic by-laws;
AND WHEREAS the Council of the Regional Corporation has by resolution on the 12th May, 1994 authorized the enactment of such a consolidated traffic by-law;
NOW THEREFORE, the Council of the Regional Corporation enacts as follows:
ENFORCEMENT:
1. (1) The provisions of this by-law shall be enforced by the Peel Regional Police and the Ontario Provincial Police.
(2) The provisions of Sections 7 and 8 may be enforced by the Provincial Offences Officers of the area municipalities.
INTERPRETATION:
2. (1) In this by-law:
(a) "Act" means The Highway Traffic Act, R.S.O. 1990 Chapter H.8 as amended;
(b) "area municipalities" means the City of Mississauga, the City of Brampton, and the Town of Caledon;
(c) "bicycle" includes a tricycle having a wheel or wheels of more than 60 centimetres in diameter;
(d) "commercial motor vehicle" means a motor vehicle having a permanently attached thereto a truck or delivery body and includes ambulances, hearses, casket wagons, fire apparatus, buses and tractors used for hauling purposes on the highways;
(e) "Commissioner" means the Commissioner of Public Works for the Region or a designate;
(f) "crosswalk" means
(i) that part of a highway at an intersection that is included within the connections of the lateral lines of the sidewalks on opposite sides of the highway measured from the curbs, or in the absence of curbs, from the edges of the roadway, or
(ii) any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by signs or by lines or other markings on the surface of the roadway;
(g) "heavy truck" means a commercial motor vehicle having a weight when unloaded, of three tonnes or more, or when loaded, of five tonnes or more, but does not include a passenger vehicle, an ambulance or any vehicle of a police or fire department;
(h) "highway" includes a common and public highway, street, avenue, parkway, driveway, square, place, bridge, viaduct or trestle, any part of which is intended for or used by the general public for passage of vehicles and includes the area between the lateral property lines thereof;
(i) "intersection" means the area embraced within the prolongation or connection of the lateral curb lines or, if none, then of the lateral boundary lines of two or more highways that join one another at an angle, whether or not one highway crosses the other;
(j) "motorcycle" means a self-propelled vehicle having a seat or saddle for the use of the driver and designed to travel on not more than three wheels in contact with the ground, and includes a motor scooter but does not include a motor-assisted bicycle;
(k) "motor vehicle" includes an automobile, motorcycle, motor assisted bicycle unless otherwise indicated in the Act, and any other vehicle propelled or driven otherwise than by muscular power, but does not include a street car, or other motorized vehicles running only upon rails, or a motorized snow vehicle, traction engine, farm tractor, self-propelled implement of husbandry or road-building machine within the meaning of the Act;
(l) "official sign" means any sign or roadway, curb or sidewalk marking or other device placed or erected on a highway under the authority of this by-law and specified in the Manual of Uniform Traffic Control Devices of Ontario for the purpose of regulating, warning and guiding traffic;
(m) "park" or "parking" when prohibited means the standing of a vehicle, whether occupied or not, except when standing temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers;
(n) "pedestrian" includes a person in a wheelchair and a child in a baby carriage;
(o) "pedestrian crossover" means a pedestrian crossover as defined in the Act;
(p) "police officer" means a member of the Peel Regional Police Force or a member of the Ontario Provincial Police Force;
(q) "public vehicle" means a motor vehicle operated on a highway by, for or on behalf of any person for the transportation for compensation of passengers, or passengers and express freight that might be carried in a passenger vehicle, but does not include the cars of electric or steam railways running only upon rails, taxicabs, car pool vehicles, nor motor vehicles operated solely within the corporate limits of one urban municipality;
(r) "roadway" means that part of the highway that is improved, designed or ordinarily used for vehicular traffic, but does not include the shoulder, and, where a highway includes two or more separate roadways, the term "roadway" refers to any one roadway separately and not to all the roadways collectively;
(s) "school bus" includes a vehicle operated by the Peel Board of Education and the Dufferin Peel Separate School Board; designed and operated for the purpose of carrying passengers.
(t)"scenic road" means a road which has a significant scenic value and attracts substantial numbers of visitors from within and beyond Regional boundaries and is designated as a scenic road by Regional Council;
(u)"stand" or "standing" when prohibited means the halting of a vehicle, whether occupied or not, except for the purpose of, and while actually engaged in receiving or discharging passengers;
(v) "stop" or "stopping" when prohibited means the halting of a vehicle even momentarily, except when necessary to avoid conflict with other traffic or except in compliance with the directions of a constable or other police officer or of a traffic control signal or sign;
(w) "through highway" means a highway or part of a highway designated as such by the Commissioner or by by-law of a municipality, and every such highway shall be marked by a stop sign or yield right-of-way sign in compliance with the regulations of the Ministry;
(x) "traffic control signal" means a signal light traffic control system specified in Section 133 of the Act, operated for the regulation and control of both vehicular and pedestrian traffic;
(y) "U-turn" means the turning of a vehicle within a highway so as to proceed in the opposite direction;
(z) "vehicle" includes a motor vehicle, trailer, traction engine, farm tractor, road-building machine and any vehicle drawn, propelled or driven by any kind of power, including muscular power, but does not include a motorized snow vehicle or a street car;
(aa) "public transit vehicle" includes a vehicle operated by Brampton Transit, Mississauga Transit, Go Transit and Peel Transhelp, designed and operated for the purpose of carrying passengers.
(2) Where any expression of time occurs or where any hour or other period of time is stated, the time referred to shall be standard time except in periods when daylight saving time is in effect, in which periods it shall be daylight saving time.
TRAFFIC SIGNS AND SIGNALS:
3. (1) The Commissioner is authorized to place or erect and to maintain such official signs and traffic control signals as are required to give effect to the provisions of this by-law or as required to warn or guide traffic for the safety or convenience of the public.
(2) No person shall place, maintain or display upon or in view of any highway any sign, signal, marking or device which purports to be or is an imitation of or resembles an official sign or traffic control signal or which conceals from view or interferes with the effectiveness of an official sign or traffic control signal.
(3) The Commissioner is authorized to erect emergency No Parking signs:
(a) when in his opinion an emergency has arisen making it desirable to prohibit parking on a highway,
(b) to facilitate the removal of snow, ice or debris from a highway, and
(c) to facilitate the construction or repair of roads, curbs, gutters, sewers and watermains.
(4) Emergency No Parking signs shall be erected at least one hour before the event commences, and shall be removed within one hour of the termination of the event.
(5) No operator of a vehicle approaching a green signal light at an intersection shall enter the intersection unless traffic in front of him is moving in a manner that would reasonably lead him to believe he can clear the intersection before the signal light turns red.
(6) Subsection (5) does not apply to the operator of a vehicle who enters an intersection for the purpose of turning to the right or left into an intersecting highway and signals his intention to make such turn prior to entering the intersection.
MISCELLANEOUS DRIVING RULES:
4. (1) The driver or operator of a vehicle emerging from a driveway, laneway or building onto a highway shall bring the vehicle to a full stop immediately before driving onto a sidewalk or footpath, and upon proceeding shall yield the right-of-way to pedestrians upon the sidewalk or footpath.
(2) Where U-turns are not prohibited under the provisions of Section 14 such a turn shall be made (subject to Section 143 of the Act) only where it can be made in safety and without interfering with other traffic.
(3) No person shall drive a motor vehicle upon a sidewalk or footpath except for the purpose of directly crossing the sidewalk or footpath.
(4) No person shall drive a motor vehicle over a raised curb except at a place where there is a ramp designed for that purpose.
PEDESTRIAN RULES:
5. (1) Except where traffic control signals are in operation or where traffic is being controlled by a police officer, a pedestrian crossing a highway at a place other than a pedestrian crossover shall yield the right-of-way to all vehicles upon the roadway, but nothing in this Section shall relieve the driver of a vehicle from the obligation of taking all due care to avoid a collision.
(2) No pedestrian shall proceed over or go under a barrier installed on a sidewalk for the purpose of prohibiting pedestrian movement.
(3) No person shall play or take part in any game or sport upon a roadway.
(4) No person on roller skates, or riding in, or by means of, any coaster, toy vehicle or similar device, shall travel on the roadway except to directly cross the roadway.
(5) When official signs to that effect are erected and on display, no pedestrian or cyclists shall cross any highway set out in Schedule I, to this by-law, Part 14, Column 1, between the limits set out in Columns 2 and 3.
REGULATIONS FOR BICYCLES:
6. (1) A person operating a bicycle upon a roadway shall ride as near the right-hand side of the roadway as practicable and shall exercise due care when passing a standing vehicle or one proceeding in the same direction.
(2) Persons operating bicycles upon a roadway shall ride in single file.
(3) No person operating a bicycle shall carry any package, bundle or article which prevents the rider from keeping both hands on the handle bars.
(4) No person shall park a bicycle on a highway except in such a manner as to cause the least possible obstruction to pedestrian or vehicular traffic.
GENERAL STOPPING AND PARKING REGULATIONS:
7. (1) No person shall park or stop any vehicle on any highway or portion thereof except as follows: (a) where there is a raised curb, on the right side of the roadway, having regard to the direction such vehicle was proceeding, with its right front and rear wheels parallel to and not more than 0.15 metres out from such curb; and (b) where there is no curb or a rolled curb, with the right front and rear wheels parallel to and as near to the right-hand limit of the highway as is practicable without stopping or parking over a sidewalk or footpath or over any part of a highway where grass is grown or which is not intended for the use of vehicles.
(2) The provisions of Subsection (1) do not apply where angle parking is permitted.
(3) Where angle parking is permitted on a highway, no person shall stop or park any vehicle except at an angle of 45 degrees from the curb or boundary of the roadway with the front end of the vehicle at such curb or boundary.
(4) Where angle parking spaces are designated by lines painted on the roadway, no person shall stop or park any vehicle except within an area designated as a parking space.
(5) Where parking is permitted on a highway designated for one-way traffic, the provisions of Subsection (1) shall include the word "left", wherever the word "right" is used.
(6) No person shall stop a vehicle on a highway in any of the following places:
(a) on or over a sidewalk, footpath or crosswalk;
(b) within an intersection;
(c) within a designated pedestrian crossover;
(d) within 9 metres of a pedestrian crossover;
(e) alongside or across the highway from any excavation or obstruction in the roadway when the free flow of traffic would thereby be impeded;
(f) on the roadway alongside of any stopped or parked vehicle;
(g) upon any bridge or within any tunnel or underpass; and
(h) on any middle boulevard or centre strip separating two roadways or adjacent to either side or ends of such middle boulevard or centre strip.
(7) No person shall sell, or offer for sale by retail, any goods if the place of offering or sale is on a highway under the jurisdiction of the Region.
(8) No person shall park a vehicle on a highway:
(a) for a longer period of time than three hours;
(b)between the hours of 2:00 a.m. and 6:00 a.m.;
(c) in front of or within 6 metres of a driveway or laneway along a roadway where the speed zone is higher than 50 km/hr and in front of or within 3 metres of a driveway or laneway, along a roadway where the speed limit is 50 km/hr or less or so as to obstruct vehicles in the use of a driveway or laneway;
(d) within 3 metres of a point on the edge of the roadway and nearest a fire hydrant;
(e) within 9 metres of an intersection as measured from the end of the corner radius;
(f)within 15 metres of the nearest rail of any level crossing of a railway;
(g) on any roadway having an overall width of less than 6 metres;
(h) within 6 metres of a point on a curb or at the edge of the roadway opposite the public entrance to or exit from a hotel as defined in The Hotel Fire Safety Act, R.S.O. 1990, Chapter H.16, or a theatre, as defined in The Theatres Act, R.S.O. 1990, Chapter T.6, or a public hall as defined in The Public Halls Act, R.S.O. 1990, Chapter P.39, while the premises are opened to the public;
(i) in such a position as will prevent the removal of any other vehicle previously parked;
(j) for the purpose of washing, greasing or repairing the vehicle, except for such repairs as have been necessitated by an emergency;
(k) for the purpose of displaying the vehicle for sale;
(l) in such a manner as to interfere with the movement of traffic or the clearing of snow from the highway; and
(m) on a roadway directly opposite a vehicle stopped or parked on the other side of the roadway, where the width of the roadway is less than 9 metres.
(9) Where official no parking signs are erected and are on display, no person shall park any vehicle on any highway:
(a) within 30 metres of an intersection as measured from the end of the corner radius;
(b) within 25 metres of a bus stop as measured from the post for the bus stop sign;
(c) within 7.5 metres of the lot lines of any fire hall on the side of the highway on which the fire hall is located or within 30 metres of the projected lot lines of such a fire hall on the opposite side of the roadway;
(d) upon that side of a highway contiguous to any school property, between the hours of 8:00 a.m. to 6:00 p.m., Monday to Friday inclusive;
(e) within the following distance of a crosswalk controlled by traffic control signals and located other than at an intersection:
(i) 15 metres of the crosswalk measured on each side of the highway in the direction of travel of vehicles on that side of the highway, and
(ii) 30 metres of the crosswalk measured on each side of the highway in the direction opposite to the direction of travel of vehicles on that side of the highway; and
(f) along a road where an Emergency No Parking prohibition is in effect.
STOPPING AND PARKING RESTRICTIONS AND PROHIBITIONS ON CERTAIN HIGHWAYS
8. (1) Where official no parking signs are erected and are on display no person shall park a vehicle at the side of any highway and between the limits set out respectively in Schedule I to this by-law, Part 1, Columns 1, 2 and 3 during the prohibited times or days set out in Column 4 of the said Part.
(2) Where official no parking signs are erected and are on display, no person shall park a vehicle at the side of any scenic road between the limits set out respectively in Schedule I to this by-law, Part 2, Columns 1, 2 and 3 during the prohibited times or days set out in Column 4 of the said Part.
(3) Where official no stopping signs to that effect are erected and are on display, no person shall stop a vehicle at the side of any highway between the limits set out respectively in Schedule I to this by-law, Part 3, Columns 1, 2 and 3 during the prohibited times or days set out in Column 4 of the said Part.
THROUGH HIGHWAYS, STOP SIGNS AND YIELD SIGNS:
9. (1) The highways set out in Schedule I to this by-law, Part 4, Column 1 between the limits set out in Columns 2 and 3 of the said Part, are, except as provided in Subsection (2) of this Section, hereby designated as through highways.
(2) The designation in Subsection (1) of this Section of a highway or portion of a highway as a through highway shall not include any intersection thereon where the road intersected is a King's Highway or where traffic control signals are installed.
(3) The intersections set out in Schedule I to this by-law, Part 5, Column 1 are designated as intersections where stop signs shall be erected facing traffic moving in the direction and on the highway set out in Column 2 of the said Part.
(4) The intersections set out in Schedule I to this by-law Part 6, Column 1 are designated as intersections where yield right-of-way signs shall be erected facing traffic moving in the direction set out in Column 2 of the said Part.
HEAVY TRAFFIC
10. (1) Except as provided in Subsection (2) of this Section, when official heavy truck restriction signs are erected and on display, no person shall move, drive, park or operate a heavy truck, on the highways set out in Schedule I to this by-law, Part 7, Column 1 between the limits set out in Column 2 of the said Part during the time or days set out in Column 3 of the said Part.
(2) Subsection (1) of this Section shall not apply to any vehicle actually engaged in making a delivery to or a collection from premises which cannot be reached except by way of a highway or a portion of highway referred to in the said Section or to prohibit the use of such vehicles for such purpose, provided that in making such delivery or collection the said highway or portion of highway is travelled only insofar as is unavoidable in getting to and from such premises.
AXLE LOAD WEIGHT RESTRICTIONS
11. (1) No commercial motor vehicle or trailer, other than a public vehicle or a two axle tank-truck or a two axle truck, while either is used as referred to in Section 122 of The Highway Traffic Act, shall be operated or drawn on the highways set out in Schedule I to this by-law, Part 8, Column 1 between the limits set out in Column 2 and 3 of the said Part, during the months or times indicated in Column 4 of the said Part when appropriate signs have been erected, where any axle of such commercial motor vehicle or trailer transmits to the highway, weight in excess of 5,000 kilograms.
(2) (i) Subsection (1) of this Section does not apply to prevent the operation of a commercial motor vehicle or trailer on the parts of the highways described in Schedule I where a special permit has been applied for and obtained from the Commissioner.
(ii)A special permit may be made subject to such terms and conditions as the Commissioner deems appropriate.
SPEED LIMITS
12. (1) The maximum rate of speed on any Regional road shall be 50 kilometres per hour, except where official signs have been erected and are on display in accordance with the maximum rates of speed prescribed in Subsection (2) of this Section.
(2) When the highways set out in Schedule I to this by-law, Parts 9, 10, and 11, Column 1, between the limits set out respectively in Columns 2 and 3 of the said Parts, have official signs erected and on display in compliance with the Regulations of the Act, the maximum rate of speed thereon shall be the rate of speed prescribed in the Parts and in any event the maximum rate of speed shall not be greater than 80 kilometres per hour.
LANE DESIGNATIONS
13. (1) The highways set out in Schedule I to this by-law, Part 12, Column 1, having been divided into clearly marked lanes between the limits set out in Column 2 of the said Part, each of the lanes indicated in Column 3 of the said Part is designated for traffic moving only in the direction or directions indicated in Column 4 of the said Part during the times or days indicated in Column 5 of the said Part;
(2) Each designation made under Subsection (1) of this Section shall be effective upon the erection of official signs indicating such designation.
TURNING MOVEMENTS
14. When an official sign to that effect is displayed, no vehicle in any intersection or portion of highway set out in Schedule I to this by-law, Part 13, Column 1, proceeding in the direction or emerging from a property set out in Column 2 of the said Part, shall be turned in the direction set out in Column 3 of the said Part, during the times or days set out in Column 4 of the said Part.
GENERAL
15. (1) This by-law applies only to highways forming part of the road system under the jurisdiction of the Region.
(2) Sections 4(2), 4(3), 4(4), 7(1), 7(2), 7(3), 7(4), 7(5), 7(6), 7(8), 7(9), 8, 10, 11, 13(1) and 13(2) shall not, if compliance therewith would be impracticable, apply to:
(a) ambulances, police or fire department vehicles or public utility emergency vehicles, or
(b) vehicles actually engaged in works undertaken for or on behalf of the Region or a public transit commission.
(3) Schedule I referred to in this by-law shall form part of this by-law and each entry in a Column of each Part of Schedule I shall be read in conjunction with the entry or entries across therefrom and not otherwise.
(4) Section 7(1), 7(5), 7(6), 7(8), 7(9), 8, 13(1) and 13(2) shall not apply to public transit vehicles, where compliance therewith would be impractical due to the placement of the bus stop for the public transit and school bus vehicles.
PENALTIES
16. (1) Every person who contravenes any provision of this bylaw, other than Sections 6, 9, 11, 12 and 13, is guilty of an offence and upon conviction is liable to a fine as provided for in The Provincial Offences Act.
(2) Every person who contravenes any provision of Sections 6, 9, 11, 12 and 13 is guilty of an offence and upon conviction is liable to a fine as provided for in The Highway Traffic Act.
PROVINCIAL OFFENCES ACT
17. (1) Part II of The Provincial Offences Act, R.S.O. 1990, Chapter P.33, as amended, applies in respect of all parking infractions under this by-law.
(2) The Clerk of the Regional Corporation may specify in writing his designate for the purposes of Section 18 of Part II of the said Provincial Offences Act as amended.
(3) All such penalties prescribed under Section 16 shall be recoverable under the said Provincial Offences Act, as amended.
VEHICLE TOWING
18. (1) In addition to any other penalties provided for in this by-law, a member of the Peel Regional Police Force, Ontario Provincial Police Force, or a Provincial Offences Officer of an area municipality may, where a motor vehicle is parked or stopped in contravention of sections 7 and 8 of this by-law, cause that motor vehicle to be removed, taken away and stored in a suitable place.
(2) All costs and charges incurred for removing, taking away and storing a motor vehicle pursuant to subsection (1) of this section, shall be a lien upon the motor vehicle, which lien may be enforced in the manner prescribed by Section 4 of The Repair and Storage Liens Act, R.S.O. 1990, Chapter R.25, as amended.
BY-LAWS REPEALED
19. That the following By-laws of the Regional Corporation are hereby repealed: By-law Numbers 92-92, 144-92, 145-92, 146-92, 25-93, 30-93, 41-93, 51-93, 52-93, 54-93, 55-93, 75-93, 84-93, 100-93, 104-93, 12-94, 15-94.
20. This by-law shall come into force and effect on the day named below.
