THE REGIONAL MUNICIPALITY OF PEEL
BY-LAW NUMBER 29-95
A by-law to authorize construction of a watermain on Cheltenham and Terra Cotta, in the Town of Caledon.
WHEREAS pursuant to section 46 of the Regional Municipalities Act, R.S.O., 1990, Chapter R.8, as amended, the Regional Corporation has the sole responsibility of the supply and distribution of water in the regional area;
AND WHEREAS the Council of the Regional Corporation has by Resolution 94-354-5 on the 13th October, 1994 authorized the construction of a watermain in Cheltenham and Terra Cotta, in the Town of Caledon, pursuant to section 221 of the Municipal Act, R.S.O. 1990, Chapter M.45, as amended, under Project 94-1020, at a total estimated cost of $4,000,000.00, hereinafter referred to as "the works;"
AND WHEREAS the Council of the Regional Corporation deems it desirable to impose a waterworks rate on the owners of certain lands in the City of Brampton, pursuant to section 221(2) of the Municipal Act, R.S.O. 1990, Chapter M.45, as amended;
NOW THEREFORE the Council of the Regional Corporation enacts as follows:
1. That the Regional Corporation shall construct the works at a total estimated cost of $4,000,000.00.
2. That the Commissioner of Public Works or the Regional Corporation's consulting engineer shall take such action as may be necessary for the preparation of a contract or contracts for the execution of the works under their supervision.
3. That the estimated capital cost attributable to the abutting property owners, all of which are situated in the Town of Caledon (formerly Township of Chinguacousy) in the Region of Peel (formerly County of Peel) and which are more specifically outlined in Schedule A attached hereto, is $313,000.00.
4. That the abutting owners' share of the capital costs be recovered by the imposition of a waterworks rate.
5. That the affected properties, as outlined in Schedule A attached hereto, shall be specially assessed a waterworks rate of $34.00 per metre of assessable frontage up to a maximum of 61 metres of assessable frontage per property payable over 15 years commencing on a date to be determined by the Treasurer and Commissioner of Finance.
