THE REGIONAL MUNICIPALITY OF PEEL
BY-LAW NUMBER 39-96
A by-law to authorize the Commissioner of Planning by delegation to exercise certain authority of Council of the Regional Corporation under the Planning Act, R.S.O. 1990 C. P. 13, as amended.
WHEREAS the Council of the Regional Municipality of Peel (hereinafter referred to as the "Council") has by resolution 96-390 on April 11, 1996 authorized the delegation to the Commissioner of Planning (hereinafter referred to as the "Commissioner") of all of the Council's authority as an approval authority under Section 51 of the Planning Act, R.S.O. 1990, Chap. P. 13, and Section 50 of the Condominium Act, R.S.O. 1990, Chap C. 26 (both as amended);
AND WHEREAS section 51.2 of the Planning Act (as amended by S.0. 1993, c. 23, s. 31) permits such delegation to occur;
NOW THEREFORE, the Council enacts as follows:
1. That the Commissioner is hereby delegated all of the Council's authority as an approval authority under Section 51 of the Planning Act and Section 50 of the Condominium Act;
2. That, despite the authority delegated hereby to the Commissioner, the Commissioner shall seek the advice of the Planning Committee and of the Council where a policy decision or a potentially difficult or controversial decision is being considered.
