THE REGIONAL MUNICIPALITY OF PEEL

BY-LAW NUMBER 39-97

A by-law to adopt estimates of all sums required during the year 1997 for the purposes of the Regional Corporation and to provide a levy on Area Municipalities.

 

WHEREAS the Regional Corporation is required by Section 24 (1) of the Regional Municipality of Peel Act, R.S.O. 1990 Chapter R.15, (hereinafter referred to as the "Act") to adopt yearly estimates of all sums required during the year for the purposes of the Regional Corporation, including the sums required by law to be provided by the Regional Council for any local boards of the Regional Corporation;

AND WHEREAS, Section 25 (1) of the Act in part provides that the Council of the Regional Corporation in each year shall levy against the area municipalities a sum sufficient for payment of the estimated current annual expenditures as adopted, and for payment of all sums required to be raised for sinking funds and principal and interest payments or sinking fund requirements in respect of debenture debt of area municipalities for the payment of which the Regional Corporation is liable under the Act or the Regional Municipalities Act, R.S.O. 1990 Chapter R.8. (herein after referred to as the Levy);

AND WHEREAS, Section 25 (2) and (3) of the Act in part provide that the Council of the Regional Corporation shall ascertain and by by-law direct what portion of the aforesaid sum shall be levied against and in each area municipality, and that all amounts so levied shall be apportioned among the area municipalities in the proportion that the whole rateable property in each area municipality bears to the whole rateable property in the Regional Area according to the last revised assessment rolls;

AND WHEREAS, a gross Policing Reapportionment Grant is to be credited to The Town of Caledon in the amount of one million, one hundred and twenty-four thousand, seven hundred and nineteen dollars, ($1,124,719);

AND WHEREAS, the Council of the Regional Corporation has adopted By-law 114-94 which provides for establishment of a Waste Management rate per tonne based upon estimated tonnage amounts to be requisitioned from each area municipality at the same time as the Levy;

AND WHEREAS, the difference between the Waste Management rate established for the prior year based upon estimated tonnage amounts and the Waste Management rate that would have been established had the actual amounts been used to calculate the rate is to be corrected by an adjustment to the Waste Management requisition to be established for the current year;

AND WHEREAS, the Final Apportionment for 1996 resulted in over and (under) levy a prior year adjustment is required;

AND WHEREAS, the Regional Council has adopted By-law 7-97 which enacted an Interim Levy against the area municipalities in the year 1997;

AND WHEREAS, the Council of the Regional Corporation has approved the 1997 Current Budget by Resolution 97-196 on February 27, 1997 and authorized the enactment of this by-law;

NOW THEREFORE the Council of the Regional Corporation enacts as follows:

1. That the gross general levy in the sum of one hundred and seventy-eight million, seven hundred and fifteen thousand, eight hundred and fifty-two dollars, ($178,715,852) be levied against the area municipalities and that the area municipalities do pay the following apportionment of that total;

2. That gross Policing Reapportionment Grant totalling one million, and one hundred twenty four thousand, seven hundred and nineteen dollars, ($1,124,719) be credited as follows:

3. That the sum of thirty-three million, three hundred and twenty-six thousand, nine hundred and seventy-three dollars, ($33,326,973) be levied against the area municipalities on a Waste Management rate of $96.810 per tonne of estimated weight of waste managed by the Waste Management System and that the area municipalities do pay the following apportionment of that total based upon the estimated weight of waste originating within each of them:

That the 1996 Waste Management deficit (surplus) based on estimated tonnage amounts be corrected by an adjustment to the Waste Management rate established for 1996 shall be as follows:

6. That the area municipalities shall be entitled to deduct from the levies in paragraph 3 those monies, excluding interest, previously billed on the Interim Levy pursuant to By-law 7-97 of the Regional Corporation as follows:

8. That any amounts not received by the Region's bank via electronic funds transfer by the due date, or by the Regional Corporation before the close of business on the due date, that being 4:30 p.m., to allow the Region to receive value for the funds on that day, shall bear interest at a rate equivalent to the highest chartered bank prime rate on the due date plus one and one half percent per annum to a maximum rate of fifteen percent per annum from the date that payment is due to the date that it is received.

9. That the Region of Peel installment due dates specified herein are set, and will be deemed amended if and as required, to be one (1) business day following the tax bill installment due dates established by each area municipality's final tax levy and collection by-law.

10. That the Treasurer and Commissioner of Finance is hereby directed and authorized to do all acts necessary to collect these levies.
