THE REGIONAL MUNICIPALITY OF PEEL

A by-law to authorize the construction of a local improvement sanitary sewer on Mississauga Road, Otami Trail and Yew Street, in the City of Mississauga.
WHEREAS the owners of properties on Mississauga Road, Otami Trail and Yew Street, in the City of Mississauga, as set out in Schedule A attached to this by-law, have petitioned for the construction of a sanitary sewer on Mississauga Road from Doulton Drive to Otami Trail, on Otami Trail from Mississauga Road to 2309 Otami Trail and on Yew Street from Otami Trial to 1581 Yew Street , in the City of Mississauga, hereinafter referred to as "the Works";
AND WHEREAS, the Regional Clerk has certified that the petition for the Works is sufficient pursuant to the requirements set out in the Local Improvement Act, R.S.O. 1990, Chapter L.26, as amended, hereinafter referred to as "the Act";
AND WHEREAS, the Council of the Regional Corporation has by Resolution 97-893, on the 9th July, 1998 authorized the construction of the Works and the imposition of a special assessment rate against affected property owners pursuant to the Act, under Project 98-2020;
NOW THEREFORE, the Council of the Regional Corporation enacts as follows:
1. That the Regional Corporation shall construct the Works at a total estimated cost of $430,000.
2. That the Works shall be constructed in accordance with the provisions set out in the Act.
3. The Commissioner of Public Works or the Regional Corporation’s consulting engineer shall take such action as may be necessary for the preparation of a contract or contracts for the execution of the Works under their supervision.
4. That pursuant to Section 24(1) of the Act, the total cost of the Works shall be financed as follows:
a) the sum of $155 per metre of assessable frontage shall be specially assessed upon the land abutting directly on the Works, as set out in Schedule A attached hereto;
b) the owners of lands abutting the Works, as set out in Schedule A attached hereto, shall be invoiced the sum of $1,550 per residential connection; and
c) the remainder of the total costs of the Works, estimated at approximately $213,635.50, shall be borne by the Regional Corporation.
