THE REGIONAL MUNICIPALITY OF PEEL

BY-LAW NUMBER 71-2000

A by-law to provide for the Regional Corporation's consent to permit an encroachment onto parts of Derry Road West (Regional Road 5), in the City of Mississauga.

WHEREAS the Corporation of the City of Mississauga has requested permission to permit the encroachment of a pedestrian trail system and pedestrian bridge encroaching upon the Region owned lands which constitute the widened limits of Derry Road West (Regional Road 5) described as Part of Lot 12, Concession 3 West of Hurontario Street, City of Mississauga, Regional Municipality of Peel, and designated as Parts 1 and 3 on reference plan 43R-24230.

AND WHEREAS pursuant to, Section 210 (107) of the Municipal Act, R.S.O. 1990, Chapter M.45, as amended, the Regional Corporation may permit encroachments onto Regional roads;

AND WHEREAS the Council of the Regional Corporation has by Resolution passed on the 26th of October, 2000 authorized the enactment of a by-law authorizing the said encroachment;

NOW THEREFORE the Council of the Regional Corporation enacts as follows:

1. The Corporation of the City of Mississauga is hereby authorized to maintain certain encroachments upon the public highway known as Derry Road West (Regional Road 5), as described herein and in accordance with the terms and conditions contained in the Encroachment Agreement dated the 1st day of September, 2000, between the Regional Municipality of Peel and The Corporation of the City of Mississauga, with respect to Part of Lot 12, Concession 3 West of Hurontario Street, City of Mississauga, Regional Municipality of Peel, and designated as Parts 1 and 3 on reference plan 43R-24230.

2. That Schedule "A" attached to this by-law is included and shall be considered part of this By-law.

3. That the Encroachment Agreement be executed on behalf of the Regional Corporation by the Regional Solicitor and the Regional Clerk and the corporate seal affixed thereto.
