THE REGIONAL MUNICIPALITY OF PEEL
 
BY-LAW NUMBER 30-2001
 
A by-law to provide for the Regional Corporation's consent to permit an encroachment onto parts of Regional Road 1 (Mississauga Road) in the Town of Caledon.

 

WHEREAS Mary Phillpott and Gordon Phillpott, the owners of the lands and premises described as Part of Lot 15, South Side of Main Street on a Plan of the Village of Belfountain, being a subdivision of Part of the East Half of Lot 10, Concession 5, West of Hurontario Street, Township of Caledon, referred to as CAL-20, and Part of Lot 9, Concession 5, West of Hurontario Street, Town of Caledon, Regional Municipality of Peel (formerly in the Township of Caledon, County of Peel) and more particularly described as Parts 1 and 2 on Reference Plan 43R-5616; and municipally known as 17176 Mississauga Road, Belfountain, has requested permission to maintain and use certain structures or improvements upon the public highway;

AND WHEREAS pursuant to, Section 210 (107) of the Municipal Act, R.S.O. 1990, Chapter M.45, as amended, the Regional Corporation may permit encroachments onto Regional roads;

AND WHEREAS the Council of the Regional Corporation has by resolution passed on the 31st day of May, 2001 authorized the enactment of a by-law authorizing the said encroachment;

AND WHEREAS the Council of the Regional Corporation enacts as follows:
  1. Mary Phillpott and Gordon Phillpott are hereby authorized to maintain certain encroachments upon the public highway known as Regional Road 1 (Mississauga Road), as described herein and in accordance with the terms and conditions contained in the Encroachment Agreement dated the 29th day of March, 2001, between the Regional Municipality of Peel and Mary Phillpott and Gordon Phillpott, with respect to Part of Lot 15, South Side of Main Street, on a Plan of the Village of Belfountain, being a subdivision of Part of the East Half of Lot 10, Concession 5, West of Hurontario Street, Township of Caledon referred to as CAL-20 and Part of Lot 9, Concession 5, West of Hurontario Street, Town of Caledon, Regional Municipality of Peel (formerly in the Township of Caledon, County of Peel) and more particularly described as Parts 1 and 2 on Reference Plan 43R-5616; and municipally known as 17176 Mississauga Road, Belfountain

  2. That Schedule "A" attached to this by-law is included and shall be considered part of this By-law.

  3. That the Encroachment Agreement be executed on behalf of the Regional Corporation by the Regional Solicitor and the Regional Clerk and the corporate seal affixed thereto.
