THE REGIONAL MUNICIPALITY OF PEEL
 
BY-LAW NUMBER 58-2001
 
A by-law to amend By-law 20-2001 titled "A by-law to repeal By-law 80-96 and establish a by-law to regulate the collection of waste in the Region of Peel".



WHEREAS the Council of the Regional Corporation has by resolution adopted on the 29th of November, 2001 authorized a by-law to amend By-law 20-2001, titled "A by-law to repeal By-law 80-96 and establish a by-law to regulate the collection of waste in the Region of Peel";

NOW THEREFORE the Council of the Regional Corporation enacts as follows:

1. That Paragraph 2 (a) of the By-law be deleted.

2. That Paragraphs 6 (12), 6 (13), 8 (2) and 13 (1) are amended by deleting "Multi-Residential" and inserting "Multi-residential" in its place.

3. That Paragraph 2 (aa) is deleted and the following substituted therefore:

""Residential Unit" means a self-contained residential dwelling unit permitted by law that is:

i) a single family detached residence;
ii) a semi-detached residence;
iii) a unit in a duplex, triplex, four-plex, five-plex or six-plex; or
iv) a unit in an apartment building, condominium complex, townhouse
v) complex, co-op complex or other similar residential complex containing six or fewer dwelling units,

but does not include a basement apartment or other apartment within a residence described in items i), ii), iii) or iv) above, and does not include a unit in a Multi-residential Complex."

4. That Paragraph 2 (n) is amended by deleting "four (4)" and inserting "six (6)".

5. That Paragraphs 2 (bb), 5 (3) and 6 (13) are amended by deleting "or Accessory Dwelling Unit".

6. That Paragraph 6 (1) is deleted and the following substituted therefore:

"Subject to subsection 6(4), no Occupier/Owner shall Set Out more than three (3) Waste Receptacles per Residential Unit per Scheduled Collection Day."

7. That Paragraph 6 (2) is deleted and the following substituted therefore:

"Notwithstanding subsection 5 (1), an Occupier/Owner may Set Out up to three (3) grocery bags of Waste per Residential Unit per Scheduled Collection Day. Each grocery bag shall constitute one (1) Waste Receptacle for the purpose of subsection 6 (1)"

8. That Paragraphs 6 (12) and 8 (2) are amended by deleting "Accessory Dwelling Unit".

9. That Schedule B is deleted and replaced with an amended Schedule B, as attached hereto.

10. That Paragraph 5 (2) h) is amended by deleting the second instance of the word "which" immediately following the word "waste".

11. That Item h) of Schedule A is amended by inserting the word "Waste" immediately following the word "Pathological".

12. That the following paragraph is inserted as paragraph 5 (8):

"No Occupier/Owner shall Set Out Recyclable Materials which are not contained in a Recycling Receptacle."

13. That the following paragraph is inserted as paragraph 5 (9):

"Where the Peel Organics Composting Program service is provided, no Occupier/Owner shall Set Out a Peel Organics Composting Program Receptacle unless it contains only Compostable Materials."

14. That the following paragraph is inserted as paragraph 5 (10):

"Where the Peel Organics Composting Program service is provided, no Occupier/Owner shall Set Out Compostable Materials which are not contained in a Peel Organics Composting Program Receptacle or Yard Waste Receptacle."

15. That Paragraph 6 (8) is deleted and the following substituted therefore:

"Notwithstanding subsection 5 (1) and 5 (8), an Occupier/Owner may Set Out corrugated cardboard:

i) beside the proper Recycling Receptacle only if it has been flattened or cut and securely tied into compact bundles of not more than 90 centimetres (36 inches) in length, 90 centimetres (36 inches) in width and 25 centimetres (10 inches) thick; or

ii) unbundled and placed in the proper Recycling Receptacle or in a separate cardboard box only if the corrugated cardboard has been flattened or cut with dimensions of not more than 90 centimetres (36 inches) in length, 90 centimetres (36 inches) in width and 25 centimetres (10 inches) thick."
