THE REGIONAL MUNICIPALITY OF PEEL
 
BY-LAW NUMBER 64-2001
 
A by-law to Adopt Official Plan Amendment Number 4.


WHEREAS in accordance with the provisions of Section 17 of the Planning Act, R.S.O. 1990, c.P.13, as amended, Council may adopt an Official Plan or amendments thereto;

AND WHEREAS the Council of the Regional Corporation has by resolution passed on the 6th day of December, 2001 authorized the adoption of Amendment Number 4 to the Regional Official Plan;

NOW THEREFORE the Council of the Regional Municipality of Peel enacts as follows:

That items 1 through 2 inclusive and the schedules and figures of Schedule "A", forming part of this by-law, constitute and are hereby adopted as Amendment Number 4 to the Official Plan of the Regional Municipality of Peel.

SCHEDULE A

AMENDMENT NUMBER 4 TO THE OFFICIAL PLAN OF THE REGIONAL MUNICIPALITY OF PEEL

1.0 Statutory Provisions

This Amendment No.4, to the Official Plan for the Regional Municipality of Peel Planning Area, which will be adopted by the Council of the Corporation of the Regional Municipality of Peel, is hereby approved under sections 17 and 21 of the Planning Act, R.S.O. 1990, c.P.13, as Amendment No. 4 to the Official Plan for the Regional Municipality of Peel Planning Area.

2.0 Region of Peel Approval

This Amendment No.4, to the Official Plan for the Regional Municipality of Peel Planning Area, will be adopted by By-law, as attached hereto.

3.0 Purpose

The purpose of this Amendment is to:

The amendment does not directly relate to lands, but would implement a study that will have influence on lands and travel patterns within the eastern portions of the Peel.

5.0 Details of the Amendment

The Document known as the Official Plan of the Regional Municipality of Peel Planning Area, as amended is further amended as follows:

1) Policy 5.6.2.11, by adding the following sentence to the end of the section, "This includes the recommendations of the York/Peel Boundary Transportation Study, which is intended to be implemented by official plan amendment."

2) Policy 5.6.3.2.3, by adding the phrase "planning corridor protection and early" following the phrase "and private road providers if appropriate, the" and adding the phrase "by official plan amendment and/or secondary plans that integrate land and transportation planning development" at the end of the section so that it reads (amended text shown in bold text):

"Support, in cooperation with the Province, the Region of York, the City of Vaughan, the City of Brampton, the Town of Caledon and private road providers if appropriate, the planning corridor protection and early construction of a major road facility running from the intersection of Highway 427 and Highway 7 northward by official plan amendment and/or secondary plans that integrate land and transportation planning development"

6.0 Implementation

Upon adoption of this Amendment, and the enabling By-law, by the Council of the Regional Municipality of Peel, the appropriate sections of the Regional Official Plan will be revised in accordance with the intent of this Amendment.

The Amendment supplements the intent and policies of the Regional Official Plan.

7.0 Implementation

The provisions of the Regional Official Plan, as amended from time to time regarding the interpretation of that Plan, will apply to this Amendment.

Amendment Rationale Result
1. Policy 5.6.2.11, by adding the text, "This includes the recommendations of the York/Peel Boundary Transportation Study, which is intended to be implemented by official plan amendment" to the end of the existing policy. This amendment is required to implement the York/Peel Boundary Transportation Study, to which both Regions have committed. "5.6.2.11 Coordinate planning with adjacent regions and municipalities, to establish a planned transportation network which considers and coordinates the road linkages across municipal boundaries that will accommodate cross-boundary traffic. This includes the recommendations of the York/Peel Boundary Transportation Study, which is intended to be implemented by official plan amendment."
2. Policy 5.6.3.2.3, by adding the phrase "planning corridor protection and early" following the phrase "and private road providers if appropriate, the"; and adding "by official plan amendment and/or secondary plans that integrate land and transportation planning development" to the end of the policy. These additions are required to implement the recommendations of the York/Peel Boundary Transportation Study.
