BY-LAW NUMBER 24-2002
 
A by-law to establish a qualitative sewer surcharge rate.



WHEREAS subsection 72(3) of the Regional Municipalities Act, R.S.O. 1990, c.R.8 provides that the Regional Corporation may finance the whole or any part of the cost, including the establishment, construction, maintenance, operation and debt charges, of collection and disposal of sewage, by imposing a surcharge on the water rate collectable in the same manner as water rates or by any method or methods authorized by law or by any combination thereof;

AND WHEREAS subsection 221(2) of the Municipal Act, R.S.O. 1990, c.M.45 authorizes the Council of a local municipality, in authorizing the construction of sewage works to impose by by-law a sewer rate upon owners or occupants of land who derive or will or may derive a benefit therefrom sufficient to pay all or such portion of the capital costs of the works as the by-law may specify;

AND WHEREAS the Council may by by-law include as part of a sewer rate imposed under subsection 221(2) of the Municipal Act a charge which could otherwise be imposed as a sewage service rate under subsection 221(20) of the Municipal Act;

AND WHEREAS section 221 of the Municipal Act is made applicable to the Regional Corporation in respect of sanitary sewage works by operation of subsection 72(2) of the Regional Municipalities Act;

AND WHEREAS By-law Number 90-90 being a by-law to regulate the discharge of matter into the sanitary and storm sewage systems of the Regional Municipality contemplates the establishment from time to time by the Regional Municipality of a rate for sewage treatment for use in the calculation of a surcharge payable in connection with a discharge into the sanitary sewers of matter containing certain effluents in excess of by-law limits;

NOW THEREFORE, the Council of the Regional Corporation enacts as follows:

1. That the qualitative sanitary sewer surcharge rate be established and fixed at $1.00 per 1,000 imperial gallons, and imposed in accordance with By-law 90-90.

2. That this by-law shall be deemed to be in force as from on and after January 1, 2002.
