THE REGIONAL MUNICIPALITY OF PEEL
 
BY-LAW NUMBER 40-2002
 
A by-law to provide for the Regional Corporation's consent to permit an encroachment onto parts of Regional Road 50 (Queen Street South) in the Town of Caledon.


WHEREAS Husky Injection Molding Systems Ltd., the owner of the lands and premises described as Part of Block 6, Plan Bol-7, Town of Caledon, designated as Part 3 on Reference Plan 43R-11489 and Part of Block B, Plan 593, designated as Parts 1 and 2 on Reference Plan 43R-17062 and as in Instrument Number RO1111757 and Part of Lots 5 and 6, Concession 6, and Part of the Road Allowance between Lots 5 and 6, Concession 6 (closed by Instrument Number RO604805), Town of Caledon (formerly Township of Albion) designated as Parts 1, 2, 3, 4, 5, 6, 7, and 8 on Reference Plan 43R-19172; and municipally known as 500-560 Queen Street South, Bolton, has requested permission to maintain and use certain structures or improvements upon the public highway;

AND WHEREAS pursuant to, Section 308 (3) of the Municipal Act, R.S.O. 1990, Chapter M.45, as amended, the Regional Corporation may permit encroachments onto Regional roads;

AND WHEREAS the Council of the Regional Corporation has by resolution passed on the 11th day of July, 2002 authorized the enactment of a by-law authorizing the said encroachment;

NOW THEREFORE the Council of the Regional Corporation enacts as follows:

1. Husky Injection Molding Systems Ltd. is hereby authorized to maintain certain encroachments upon the public highway known as Regional Road 50 (Queen Street South) as described herein and in accordance with the terms and conditions contained in the Encroachment Agreement dated the 10th day of June, 2002, between the Regional Municipality of Peel and Husky Injection Molding Systems Ltd., with respect to Part of Block 6, Plan Bol-7, Town of Caledon, designated as Part 3 on Reference Plan 43R-11489 and Part of Block B, Plan 593, designated as Parts 1 and 2 on Reference Plan 43R-17062 and as in Instrument Number RO1111757 and Part of Lots 5 and 6, Concession 6, and Part of the Road Allowance between Lots 5 and 6, Concession 6 (closed by Instrument Number RO604805), Town of Caledon (formerly Township of Albion) designated as Parts 1, 2, 3, 4, 5, 6, 7, and 8 on Reference Plan 43R-19172; and municipally known as 500-560 Queen Street South, Bolton.

2. That Schedule "A" attached to this by-law is included and shall be considered part of this By-law.

3. That the Encroachment Agreement be executed on behalf of the Regional Corporation by the Regional Solicitor and the Regional Clerk and the corporate seal affixed thereto.
