BY-LAW NUMBER 45-2002 |
A by-law to provide for the Regional Corporation's consent to permit an encroachment onto parts of Regional Road 107 (Bovaird Drive) and Regional Road 1 (Mississauga Road) in the City of Brampton. |
WHEREAS Calldron Gas Bars Ltd., the owner of the lands and premises described
as Part of Lot 10, Concession 5, West of Hurontario Street, City of Brampton,
Regional Municipality of Peel (formerly in the Township of Chinguacousy, County
of Peel) and more particularly described in Property Identifier Number 14092-0003(LT),
save and except Parts 1 to 7, both inclusive, on draft reference plan number
2788-1 prepared by Tarasick, McMillan Limited and municipally known as 2025
Highway 7 West, has requested permission to maintain and use certain structures
or improvements upon the public highway and 0.30m Reserve;
AND WHEREAS pursuant to, Section 308 (3) of the Municipal Act, R.S.O. 1990,
Chapter M.45, as amended, the Regional Corporation may permit encroachments
onto Regional roads;
AND WHEREAS the Council of the Regional Corporation has by resolution passed
on the 8th day of August, 2002 authorized the enactment of a by-law authorizing
the said encroachment;
AND WHEREAS the Council of the Regional Corporation enacts as follows:
1. Calldron Gas Bars Ltd. is hereby authorized to maintain certain encroachments upon the public highway known as Regional Road 107 (Bovaird Drive) and Regional Road 1 (Mississauga Road) and portions of the 0.30m reserve adjacent thereto, as described herein and in accordance with the terms and conditions contained in the Encroachment Agreement dated the 5th day of April, 2002, between the Regional Municipality of Peel and Calldron Gas Bars Ltd., with respect to Part of Lot 10, Concession 5, West of Hurontario Street, City of Brampton, Regional Municipality of Peel (formerly in the Township of Chinguacousy, County of Peel) and more particularly described as Parts 1, 2, 3, 4, 5, 6 and 7 on draft reference plan number 2788-1 prepared by Tarasick, McMillan Limited.
2. That Schedule "A" attached to this by-law is included and shall be considered part of this By-law.
3. That the Encroachment Agreement be executed on behalf of the Regional Corporation by the Regional Solicitor and the Regional Clerk and the corporate seal affixed thereto.
