WHEREAS pursuant to section 50 of the Regional Municipalities Act, R.S.O. 1990, Chapter R.8, as amended, the Regional Municipality of Peel, hereinafter referred to "the Regional Corporation", has the sole responsibility for the collection and disposal of all sewage in the Regional area;

AND WHEREAS the Council of the Regional Corporation has by Resolution 2000-1179 on the 14th day of December 2000, authorized the construction of a watermain on Cliffside Drive from the intersection of Cliffside Drive and Embleton Road to House 78 Cliffside Drive in the City of Brampton for an estimated distance of 250 m (820 feet), hereinafter referred to as the "Works", pursuant to section 221 of the Municipal Act, R.S.O. 1990, Chapter M.45, as amended, under Project 00-1030;

AND WHEREAS Council of the Regional Corporation deems it desirable to impose a water works rate on the Owners of certain lands in the City of Brampton pursuant to section 221 of the Municipal Act, R.S.O. 1990, Chapter M.45, as amended;

NOW THEREFORE the Council of the Regional Corporation enacts as follows:

1. That the Regional Corporation construct the Works at a total cost of $121,759.60.

2. The total cost of the Works being $121,759.60 shall be financed as follows:

a) The amount of $53,782.60 shall be financed entirely by the Regional Corporation.

b) The amount of $67,977.00 shall be recovered by means of a water works rate imposed upon properties abutting the Works as set out in Schedule A attached hereto in the following manner:

i) By a water works rate of $249.00 per metre ($75.89 per foot) of accessible frontage, which water works rate with interest thereon at 5.4% per annum for fifteen (15) years, shall be payable in fifteen (15) equal annual installments of $24.65 per metre of accessible frontage;

3) That the said water works rate shall be an annual charge and shall be imposed for a period of fifteen (15) years commencing on a date to be specified by the Treasurer and Commissioner of Finance of the Regional Corporation. The due date for payment of the water works rate shall be sixty (60) days from date of invoice for each payment.

4) That if a new part or parcel of land is created within an existing part or parcel of land affected by this by-law before the end of the fifteen (15) year period referred to herein, the newly created part or parcel of land shall also be subject to the water works rate established in this by-law as if the part or parcel was in existence on the date this by-law is passed.

5) That any person whose land is specially assessed may commute for payment in cash the special rate imposed thereon by paying the portion of the cost of the construction assessed upon such land without interest within a time specified by the Regional Corporation.
