THE REGIONAL MUNICIPALITY OF PEEL
 
BY-LAW NUMBER 28-2003
 
A by-law to withdraw from the Land Division Committee, the authority of Council to give consent under the Planning Act, R.S.O. 1990 Chapter P. 13, as amended; to delegate such authority to the Town of Caledon; and to repeal By-Law 66-97.


WHEREAS pursuant to subsection 53(1) of the Planning Act, R.S.O. 1990, Chapter P.13, as amended, (hereinafter referred to as the "Act") the Council of the Regional Municipality of Peel may upon an application, give consents if satisfied that a plan of subdivision is not necessary for the proper and orderly development of the municipality;

AND WHEREAS pursuant to subsection 54(1) of the Act, the authority for the giving of consents pursuant to subsection 53(1) of the Act may be delegated by the Council of the Regional Municipality of Peel (hereinafter referred to as the Council) to the council of a constituent area municipality with respect to land situate in the area municipality;

AND WHEREAS Council, has by Resolution authorized that the authority of Council for the giving of consents pursuant to subsection 53(1) of the Act be delegated to the Council of the Town of Caledon with respect to land situate in the Town of Caledon;

AND WHEREAS pursuant to subsection 54(2.1) of the Act the delegation of authority for the giving of consents is deemed to include authority to give approvals under subsection 50(18) of the Act and to issue certificates of validation under section 57 of the Act;

AND WHEREAS pursuant to subsection 54(7) of the Act, Council may by by-law withdraw the delegation to the land division committee of its authority to give consents;

NOW THEREFORE the Council of the Regional Corporation enacts as follows:

1. THAT the authority of Council to give consents under section 53 of the Planning Act, R.S.O. 1990, P. 13, as amended, with respect to land situate in the Town of Caledon is hereby delegated to the Council of the Corporation of the Town of Caledon effective as of and from the second day of June, 2003;

2. AND FURTHER THAT this by-law shall come into force and effect on the second day of June, 2003;

3. AND FURTHER THAT the authority of Council to give consent under section 53 including the giving of approvals under section 50(18) and the issuance of certificates of validation under section 57 of the Planning Act, R.S.O., 1990, P. 13 as amended, with respect to land situate in the Town of Caledon is withdrawn from the Land Division Committee, effective as of and from the second day of June, 2003;

4. AND FURTHER THAT a certified copy of this by-law be sent to the Minister of Municipal Affairs by registered mail by the Deputy Regional Clerk within thirty days of the passing thereof;

5. AND FURTHER THAT By-law 66-97 is repealed as of and from the second day of June, 2003.
