WHEREAS the Council of the Regional Municipality ("Regional Corporation") on November 22, 1990, passed By-Law 90-90 to regulate the discharge of matter into the sanitary and storm sewage systems of the Regional Corporation and to make provision for the establishment of sewer rates and charges for use of its property, and for services and activities provided by the Regional Corporation;

WHEREAS the Council of the Regional Corporation on December 12, 2002, passed By-Law 66-2002 imposing the qualitative sewer surcharge rate and establishing sewer waste disposal charges enacted for the purposes of By-Law 90-90;

WHEREAS the Council of the Regional Corporation on February 12, 2004, passed By-Law 27-2004 to enact a qualitative sanitary sewer surcharge rate and sewer waste disposal charge in accordance with Schedule A attached to By-Law 27-2004;

WHEREAS the Council of the Regional Corporation on March 4, 2004 enacted By-Law 1-2004 amending By-Law 66-2002 to delete the qualitative sewer surcharge rate and sewer waste disposal charges under By-Law 66-2002;

WHEREAS the Council of the Regional Corporation has by resolution adopted on November 18, 2004, authorized that By-Law 27-2004 be amended to substitute the rates and charges set out in Schedule A hereto for the corresponding rates and charges set out in Schedule A to By-Law 27-2004;

NOW THEREFORE, the Council of the Regional Corporation enacts as follows:

1. That the Qualitative Sanitary Sewer Surcharge Rate set out in Schedule A to By-Law 27-2004 is amended to substitute and replace the rates and charges set out in Schedule A attached hereto for the comparable corresponding rates and charges set out in Schedule A to By-Law 27-2004 for the purposes of By-Law 90-90 and for such other purposes as for the enactment of a Qualitative Sanitary Sewer Surcharge Rate may be required.

2. This by-law and attached Schedule A outlining the Qualitative Sanitary Sewer Surcharge Rate is hereby adopted and enacted.

3. Despite the amendment of By-Law 27-2004 herein, the Qualitative Sewer Surcharge Rate and Sewer Waste Disposal Charge on the day immediately prior to the day this by-law comes into effect, shall continue in effect to but not including the date upon which this by-law comes into effect.

4. This By-Law may be referred to as the "Sewer Surcharge Rate and Sewer Waste Disposal Charge By-Law, 2005."

5. This By-law takes effect on the day that it is passed.

By-law 133-2004 amending By-law 27-2004

That the rates set out below are effective for all accounts rendered from January 1, 2005.

1. Qualitative Sanitary Sewer Surcharge Rate: $235.00 per 1000 cubic meters

2. Sewer Waste Disposal Charge: $13.00 per 1000 gallons
