BY-LAW NUMBER 24-2004
 
A by-law to amend By-Law 9-73 being the Water Rate Charge By-Law


WHEREAS the Council of the Regional Municipality ("Regional Corporation") on December 31, 1973 passed By-Law 9-73 respecting the supply of water, the management and maintenance of the Waterworks System of the Regional Corporation and the establishment of water rates and charges;

AND WHEREAS the Council of the Regional Corporation on December 12, 2002, passed By-Law 66-2002, being an omnibus User Fee By-Law to impose fees for services and activities provided by the Regional Corporation;

AND WHEREAS By-Law 66-2002 amends By-Law 43-2002, thereby by virtue of section 7 of By-Law 43-2002 amending By-Law 9-73 by amending Schedule A to By-Law 9-73 with a new Schedule A that imposes fees for water services and activities;

AND WHEREAS Ontario Regulation 244/02 under the Municipal Act, 2001, imposes enhanced public notification requirements in the case of waste management, water and wastewater system charges and fees;

AND WHEREAS the Council of the Regional Corporation has by resolution adopted on February 12, 2004, authorized that By-Law 66-2002 be amended to delete the waste management, water and wastewater system charges and fees;

AND WHEREAS the Council of the Regional Corporation has by resolution adopted on February 12, 2004, authorized that By-Law 9-73 being the Water Rate Charge By-Law be amended to include the water rates and charges in accordance with Schedule A attached hereto;

NOW THEREFORE, the Council of the Regional Corporation enacts as follows:

1. Schedule A to By-Law 9-73, as amended, is further amended to substitute the rates and charges set out in Schedule A attached hereto for the comparable corresponding rates and charges set out in Schedule A to By-Law 9-73, as amended.

2. That the rates and charges for water services and activities contained in Schedule A hereto are hereby adopted and that the water rates set out therein take effect upon passing of this by-law.

3. The water rates and fees set out in Schedule A, on the day immediately prior to the day this by-law comes into effect, shall continue to apply to water fees for all bills rendered prior to the date upon which this by-law comes into effect.

4. By-Law 9-73 as amended by clause 8(ii) of By-Law 43-2002 is hereby amended by deleting clause 7.1 thereof and substituting the following therefor:
"The rates and charges set forth in Schedule "A" hereto are enacted as the rates or charges for the work or services shown thereon. Where by agreement the Regional Corporation agrees to special rates and or charges, such agreement will take precedence over the by-law."

5. This By-Law may be referred to as the "Water System Fees and Charges By-Law, 2004."

6. This By-law takes effect on the day that it is passed.

Schedule "A" to By-law 24-2004

That the rates set out in section 1 below are effective for all accounts rendered from the passing of this by-law up to and including bills rendered on March 31, 2004. The rates in section 2 are effective for all accounts rendered on or after April 1, 2004.

1. (1) Unmetered Consumption

A flat rate of $6.00 per month for consumers whose water consumption is unmetered.

(2) Consumption Rates

Each metered service shall be billed separately. The metered rates shall be as follows:

(a) $1.91 per thousand Imperial gallons metered, and

(b) $4.2008 per ten cubic metres (10m3) metered.

2. (1) Unmetered Consumption

A flat rate of $6.00 per month for consumers whose water consumption is unmetered.

(2) Consumption Rates

Each metered service shall be billed separately. The metered rates shall be as follows:

(c) $2.01 per thousand Imperial gallons metered, and

(d) $4.4108 per ten cubic metres (10m3) metered.
