THE REGIONAL MUNICIPALITY OF PEEL
 
BY-LAW NUMBER 106-2005
 
A by-law to delegate to the City of Mississauga all power to pass a by-law respecting the destruction or injuring of trees in woodlands, within the jurisdictional boundaries of the City of Mississauga.


WHEREAS the Regional Municipality of Peel has the authority pursuant to section 135(8) of the Municipal Act, 2001, as amended (hereinafter referred to as the "Act"), to delegate all or part of its power to pass a by-law respecting the destruction or injuring of trees in woodlands to one or more of its lower-tier municipalities with the agreement of the lower-tier municipality or municipalities, as the case may be;

AND WHEREAS "woodlands" means woodlands as defined in the Forestry Act that are one hectare or more in area;

AND WHEREAS the City of Mississauga requests the Regional Municipality of Peel to delegate its power to pass a by-law respecting the destruction or injuring of trees in woodlands to the City of Mississauga;

NOW THEREFORE the Council of the Regional Municipality of Peel enacts as follows:

1. That all power to pass a by-law respecting the destruction or injuring of trees in woodlands, within the jurisdictional boundaries of the City of Mississauga, is hereby delegated to the City of Mississauga.
