THE REGIONAL MUNICIPALITY OF PEEL
 
BY-LAW NUMBER 67- 2005
 
A by-law to amend By-law No. 52-2002 to provide for the conveyance of part of the lands described in Schedule "B" of By-law No. 52-2002, described as Part Lot 1, Range 3, Credit Indian Reserve, City of Mississauga, Regional Municipality of Peel designated as Part 1 on Reference Plan 43R-28265 (being a portion of Parts 44, 45 and 57 on Plan 43R-12522) to the Trillium Health Centre instead of Hydro One Networks Inc.

 

WHEREAS the Council of the Regional Corporation enacted By-law No. 52-2002 on November 21, 2002;

AND WHEREAS By-law No. 52-2002 provided in part that certain lands described in Schedule "B" to that by-law be offered for sale to Hydro One Networks Inc.;

AND WHEREAS a part of the lands to be offered for sale to Hydro One Networks Inc., more particularly described as Part Lot 1, Range 3, Credit Indian Reserve, City of Mississauga, Regional Municipality of Peel designated as Part 1 on Reference Plan 43R-28265 (being a portion of Parts 44, 45 and 57 on Plan 43R-12522) (the "Subject Lands") are the subject of a report by the Commissioner of Corporate Services and Regional Solicitor and the Commissioner of Housing and Property and General Manager, Peel Living dated July 29, 2005 recommending that they be conveyed gratuitously to the Trillium Health Centre subject to certain requirements outlined in the said report and recommendation;

AND WHEREAS the Subject Lands have been declared by the Council of the Regional Corporation to be surplus to the needs of the Regional Corporation, have been subject of notice to the public of their proposed sale and are lands which do not have direct access to a highway;

AND WHEREAS Trillium Health Centre is the owner of land abutting the Subject Lands;

AND WHEREAS the Regional Corporation accordingly has authority to sell the Subject Lands pursuant to section 268 of the Municipal Act, 2001;

AND WHEREAS the Council of the Regional Corporation has by resolution adopted on August 11, 2005 authorized the sale of the Subject Lands and directed that this by-law be presented for enactment;

NOW THEREFORE, the Council of the Regional Corporation enacts as follows:


1. That By-law No. 52-2002 is amended by the insertion immediately following clause 2 of the following clause 2.1:

"2.1 That despite clause 2, the conveyance by the Regional Corporation of the soil and freehold of that part of the lands described in Schedule 'B" attached hereto and more particularly described as Part Lot 1, Range 3, Credit Indian Reserve, City of Mississauga, Region of Peel Designated as Part 1 on Reference Plan 43R-28265 (being a portion of Parts 44, 45 and 57 on Plan 43R-12522) to Trillium Health Centre is hereby authorized."

2. That By-law No. 52-2002 is amended by the addition immediately following clause 3 of the following clause 3.1:

"3.1 That the conveyance of the lands described in clause 2.1, be subject to such easements as may be necessary to protect the existing public utility works within the lands described in clause 2.1, if any, and such easements as may be required by Hydro One Networks Inc., if any, and that the conveyance of such easements, if any, be made prior to the transfer of the lands to Trillium Health Centre."
