THE REGIONAL MUNICIPALITY OF PEEL
 
BY-LAW NUMBER 70- 2005
 
A by-law to provide for the Regional Corporation's consent to permit an encroachment onto parts of Regional Road 50 (Highway 50) in the Town of Caledon.

 

WHEREAS The Corporation of the Town of Caledon, the owner of the lands and premises being Firstly described as Part of Lots 18 and 19, Block 4, Plan Bol-7, Town of Caledon (formerly Village of Bolton), Regional Municipality of Peel, designated as Part 1 on Reference Plan 43R-7912, PIN 14317-0021(R) and Secondly described as Part of Lots 27 and 28, Part Water Street, Block 5, Plan Bol-7, Part Lot C, Plan Bol-9, designated as Part 8 on Reference Plan 43R-10779, Part Lot 184, Block 1, Plan Bol-7, Part Lot B, Plan Bol-9, Part Lot 30, Plan Bol-9 as in VS291299, Town of Caledon (formerly Village of Bolton), Regional Municipality of Peel, save and except Parts 2, 3, 4, 5, 6, 7, 8 and 9 on Reference Plan 43R-10357, Parts 1, 2 and 3 on Reference Plan 43R-10780 and Parts 2, 3, 4 and 5 on Reference Plan 43R-10781, PIN 14358-0307(LT), has requested permission to maintain and use certain structures or improvements upon the public highway (the "encroachment");

AND WHEREAS pursuant to Section 11(2) of the Municipal Act, 2001, S.O. 2001, c.25, the Regional Corporation may pass a by-law respecting encroachments on Regional roads;

AND WHEREAS the Council of the Regional Corporation has by resolution passed on the 15th day of September, 2005 authorized the enactment of a by-law authorizing the encroachment;

NOW THEREFORE the Council of the Regional Corporation enacts as follows:

1. That The Corporation of the Town of Caledon is hereby authorized to maintain the encroachment upon the public highway known as Regional Road 50 (Highway 50), as described herein and in accordance with the terms and conditions contained in the Encroachment Agreement dated the 9th day of May, 2003, between The Regional Municipality of Peel and The Corporation of the Town of Caledon and as shown on drawing number F462-1.dwg, dated July 8, 2002, prepared by the Toronto and Region Conservation Authority and filed in Region of Peel Real Estate File ENC-01032.00.

2. That Schedule "A" attached to this by-law is included and shall be considered part of this By-law.

3. That the Encroachment Agreement be executed on behalf of the Regional Corporation by the Commissioner of Corporate Services and the Regional Clerk and the corporate seal affixed thereto.
