BY-LAW NUMBER 73-2005 |
A by-law to abandon the expropriation of land being
Part of Block 177, Registered Plan 43M-1427, in the City of Brampton,
Regional Municipality of Peel, being more particularly identified as Parts
5, 6, 7, 8, 9 and 10 on Expropriation Plan PR834823 subject to a two-year
temporary easement.

WHEREAS the Council of the Regional Corporation enacted By-Law No. 74-2004
on October 28, 2004 authorizing commencement of the expropriation of the above-described
lands (the "Lands") for the purposes set out therein;
AND WHEREAS the Council of the Regional Corporation enacted By-Law No. 16-2005
on January 27, 2005 approving the expropriation of the Lands for the purposes
set out therein;
AND WHEREAS the Regional Corporation has determined that the fee simple interest in the Lands is no longer necessary and that only a temporary easement over the Lands is required;
NOW THEREFORE the Council of the Regional Corporation enacts as follows:
1. The fee simple interest in the Lands is hereby declared to be unnecessary
for the purposes of the Regional Corporation and shall be abandoned pursuant
to s. 41 of the Expropriations Act, R.S.O. 1990, c.E.26, as amended (the "Act")
subject to the retention of a temporary easement or right in the nature of a
temporary easement, expiring on August 15, 2007, in, under, over, along and
upon the said Lands for the purpose of entering upon and occupying the Lands
with all necessary vehicles, machinery, equipment and material for the purpose
of grading;
2. That if all owners who were served with the Notice of Expropriation elect
to take back their interest in the Lands, applicable documentation be prepared
and registered in the proper land registry office evidencing the abandonment
subject to retention of the temporary easement, in accordance with the Act.
READ THREE TIMES AND FINALLY PASSED IN OPEN COUNCIL this 15th day of September,
