WHEREAS 1599045 Ontario Limited, the owner of the lands and premises described as Part of Lot 15, Concession 5 East of Hurontario Street, City of Brampton (formerly Township of Toronto), Regional Municipality of Peel, designated as Parts 2, 6, 8 and 9 on Reference Plan 43R-28918, has requested permission to maintain and use certain structures or improvements upon the public highway (the "encroachment");

AND WHEREAS pursuant to Section 11(2) of the Municipal Act, 2001, S.O. 2001, c.25, the Regional Corporation may pass a by-law respecting encroachments on Regional roads;

AND WHEREAS the Council of the Regional Corporation has by resolution passed on the 15th day of December, 2005 authorized the enactment of a by-law authorizing the encroachment;

NOW THEREFORE the Council of the Regional Corporation enacts as follows:

1. That 1599045 Ontario Limited is hereby authorized to maintain the encroachments upon the public highway known as Regional Road 15 (Steeles Avenue), as described herein and in accordance with the terms and conditions contained in the Encroachment Agreement dated the 17th day of October, 2005, between The Regional Municipality of Peel and 1599045 Ontario Limited and as shown on drawing number #RC58 prepared by Rabideau & Czerwinski Ontario Land Surveyors and filed in Region of Peel Real Estate File ENC-04097.00.

2. That Schedule "A" attached to this by-law is included and shall be considered part of this By-law.

3. That the Encroachment Agreement be executed on behalf of the Regional Corporation by the Commissioner of Corporate Services and the Deputy Clerk and the corporate seal affixed thereto.
