WHEREAS Loblaw Properties Limited, the owner of the lands and premises described as Part of Lots 1 to 6 and Part Lots 11, 12 and 13, Registered Plan 347, with exceptions as described in PINS 14079-0011, 14079-0329, 14079-0339, 14079-0341 and 14079-0349, City of Brampton, Regional Municipality of Peel, has requested permission to maintain and use certain structures or improvements upon the public highway (the "encroachment");

AND WHEREAS pursuant to Section 11(2) of the Municipal Act, 2001, S.O. 2001, c.25, the Regional Corporation may pass a by-law respecting encroachments on Regional roads;

AND WHEREAS the Council of the Regional Corporation has by resolution passed on the 26th day of January, 2006 authorized the enactment of a by-law authorizing the encroachment;

NOW THEREFORE the Council of the Regional Corporation enacts as follows:

1. That Loblaw Properties Limited is hereby authorized to maintain the encroachments upon the public highway known as Regional Road 15 (Steeles Avenue), as described herein and in accordance with the terms and conditions contained in the Encroachment Agreement dated the 15th day of December, 2005, between The Regional Municipality of Peel and Loblaw Properties Limited and as shown on Landscape Plan for site plan SP04-026 prepared by Ron Koudys Landscape Architect Inc. and filed in Region of Peel Real Estate File ENC-05084.00.
   
   
2. That Schedule "A" attached to this by-law is included and shall be considered part of this By-law.
   
   
3. That the Encroachment Agreement be executed on behalf of the Regional Corporation by the Commissioner of Corporate Services and the Deputy Clerk and the corporate seal affixed thereto.
