THE REGIONAL MUNICIPALITY OF PEEL
 
BY-LAW NUMBER 108-2007
 

A by-law to assign to the City of Mississauga certain responsibilities of the Regional Municipality of Peel under the Growth Plan for the Greater Golden Horseshoe.

WHEREAS the Province of Ontario enacted the Places to Grow Act, 2005, S.O. 2005, c.13, for the purpose of enabling decisions about growth to be made in ways that sustain a robust economy, build strong communities and promote a healthy environment and a culture of conservation, and also for the purpose of promoting a rational and balanced approach to decisions about growth that builds on community priorities, strengths and opportunities, and makes efficient use of infrastructure;

AND WHEREAS the Minister of Public Infrastructure Renewal has prepared a Growth Plan under the said Act for the area designated as the Greater Golden Horseshoe growth plan area, by Ontario Regulation 416/05 under the said Act;

AND WHEREAS the Minister of Public Infrastructure Renewal has submitted the Growth Plan for the Greater Golden Horseshoe to the Lieutenant Governor in Council and the said Growth Plan was approved by the Lieutenant Governor in Council by Order-in-Council No. 1221/2006, and took effect on June 16, 2006;

AND WHEREAS policy 5.4.2.4 of the Growth Plan permits an upper-tier municipality to assign some or all of its responsibilities pursuant to the policies of the Growth Plan to a lower-tier municipality if the population of such lower-tier municipality is greater than 50 percent of the population of the upper-tier municipality;

AND WHEREAS the Council of the Regional Municipality of Peel considers it to be consistent with the discharge of the Regional Municipality’s responsibilities under the Growth Plan to assign certain responsibilities to the City of Mississauga;

NOW THEREFORE the Council of the Regional Corporation enacts as follows:

  1. That the responsibility of The Regional Municipal of Peel pursuant to clause (b) of policy 5.4.2.2 of the Growth Plan for the Greater Golden Horseshoe, as approved by the Lieutenant-Governor in Council under the Places to Grow Act, 2005, to identify intensification targets for lower tier municipalities in order to achieve the intensification target and density targets for urban growth centres, is assigned to the Corporation of the City of Mississauga (“Mississauga”) with respect to the establishment of the density target for the urban growth centre identified as “Mississauga City Centre” in Schedule 4 to the said Growth Plan.
  2. That, in establishing the density target for the urban growth centre identified as “Mississauga City Centre”, Mississauga shall consult with the Commissioner of Environment, Transportation and Planning Services of The Regional Municipality of Peel, and shall ensure that the density target which is established for “Mississauga City Centre” is in full compliance with the requirements of The Regional Municipality of Peel with respect to the provision of all Regional services, and that the delivery, timing or financing of engineering or related services within the City of Brampton or the Town of Caledon is not compromised as a result of establishing the density target for “Mississauga City Centre”.
  3. That the Commissioner of Environment, Transportation and Planning Services shall monitor the actions of Mississauga in carrying out the responsibilities assigned under this By-law, and shall report to the Council of The Regional Municipality of Peel if Mississauga is proposing to establish or has established a density target for “Mississauga City Centre” which is not in full compliance with the requirements of The Regional Municipality of Peel with respect to the provision of all Regional services, or if such actions by Mississauga would compromise the delivery, timing or financing of engineering or related services within the City of Brampton or the Town of Caledon. Upon receipt of such report, the Council may revoke this assignment by giving not less than thirty days notice in writing to the Clerk of the Corporation of the City of Mississauga.
  4. The Council of The Regional Municipality of Peel may revoke this assignment at any time when Mississauga’s population is less than 50 percent of the population of The Regional Municipality of Peel, as determined by reference to the Census Population figures provided by Statistics Canada, subject to any amendments to the Places to Grow Act, 2005, or to the Growth Plan for the Greater Golden Horseshoe which affect the authority of The Regional Municipality of Peel to assign some or all of its responsibilities under the Growth Plan.
  5. This By-law takes effect on the day that it is passed.
