THE REGIONAL MUNICIPALITY OF PEEL
 
BY-LAW NUMBER 17-2007
 

A by-law to establish the Waste Management System Fees and Charges and to repeal By-law 6-2006 titled the "Waste Management System Fees and Charges By-law, 2006".

WHEREAS pursuant to subsection 11(2) and Part XII of the Municipal Act, 2001, S.O. 2001, c. 25, the Council of The Regional Municipality of Peel ("Regional Corporation") has the authority to pass by-laws imposing fees or charges for the use of its waste management system;

AND WHEREAS Council of the Regional Corporation on July 11, 2002 enacted By-law 43-2002 to impose fees for services and activities provided by the Regional Corporation or for the use of its property;

AND WHEREAS Council of the Regional Corporation on December 12, 2002 enacted By-law 66-2002 to amend By-law 43-2002 by deleting and replacing Schedule A attached to By-law 43-2002 with an amended Schedule A attached to By-law 66-2002;

AND WHEREAS Council of the Regional Corporation on February 12, 2004, enacted By-law 25-2004, being a stand-alone by-law to establish waste management system fees and charges;

AND WHEREAS By-law 66-2002 was amended on March 4, 2004 to delete the waste management system fees contained therein;

AND WHEREAS Council of the Regional Corporation on July 8, 2004, enacted By-law 54-2004, to amend By-law 25-2004 to enact waste management system fees and charges in accordance with Schedule A attached thereto;

AND WHEREAS Council of the Regional Corporation on October 27, 2005 enacted By-law 82-2005 to repeal and replace By-law 54-2004 and to enact waste management system fees and charges in accordance with Schedule A attached thereto;

AND WHEREAS Council of the Regional Corporation has by resolution adopted on January 17, 1985 authorized the establishment of charge accounts for regular users of the Landfill facilities of the Regional Corporation under certain conditions;

AND WHEREAS Council of the Regional Corporation has by resolution adopted on October 24, 1985 authorized the Treasurer and Commissioner of Finance to add interest at the rate of 1.5 % to the outstanding balance of any account remaining unpaid after 30 days;


AND WHEREAS Council of the Regional Corporation on January 26, 2006 enacted By-law 6-2006 to repeal By-law 82-2005 and to establish the Waste Management System Fees and Charges in accordance with Schedule A attached thereto;

AND WHEREAS Council of the Regional Corporation has by resolution adopted on February 15, 2007 authorized that the by-law herein be enacted to establish the waste management system fees and charges in accordance with Schedule A attached hereto;

NOW THEREFORE the Council of the Regional Corporation enacts as follows:

1. This by-law, the attached Schedule A and the waste management system fees and charges provided for therein are hereby adopted, enacted and imposed.

2. The waste management system fees and charges set out in Schedule A to this By-law are generally due and payable at the time the drop off of waste is made. However, regular users of the Regional Corporation's Landfill facilities may be permitted to open a charge account, in order that their individual trips to the sites may be recorded and an invoice sent to them monthly, upon the following terms:

(a) the user must submit to the Regional Corporation, Department of Finance, Revenues Section, a Letter of Credit, in suitable format, with a value equal to the waste management system fees and charges for an average month's service for that user;

(b) charge accounts shall be revoked if a draw upon the submitted Line of Credit is required to pay an overdue account;

(c) revoked charge accounts shall be reinstated only if all outstanding amounts have been paid and a Letter of Credit, in suitable format, with a value equal to two times the user's average monthly service, is delivered to the Regional Corporation, Department of Finance, Revenues section;

(d) after one year of satisfactory payment performance, the value of the Letters of Credit for reinstated charge accounts shall be reduced to the amount equal to one month's average service for that user; and

(e) interest may be charged, at the rate of 1.5 % per month, to the outstanding balance of any account remaining unpaid after 30 days following the issue of the invoice.

3. By-law 6-2006 is hereby repealed upon the passing of this by-law.

4. Despite the repeal of By-law 6-2006 herein, the waste management system fees and charges set out in Schedule A to By-law 6-2006, on the day immediately prior to the date this by-law comes into effect, shall continue to apply to waste management system fees and charges which became payable prior to the date upon which this by-law comes into effect.

5. This By-law may be referred to as the "Waste Management System Fees and Charges By-law, 2007".

6. This By-law takes effect on the day that it is passed.
