THE REGIONAL MUNICIPALITY OF PEEL
 
BY-LAW NUMBER 24-2007
 

A by-law to provide for the Regional Corporation's consent to permit an encroachment onto parts of Regional Road 17 (Cawthra Road) in the City of Mississauga.

WHEREAS 656731 Ontario Limited, the owner of the lands and premises described as Part of Lots 104, 105 and 106, Plan C23, City of Mississauga, Regional Municipality of Peel, designated as Part 5 on Reference Plan 43R-29625, has requested permission to maintain and use certain structures or improvements upon the public highway (the "encroachment");

AND WHEREAS pursuant to Section 11(2) of the Municipal Act, 2001, S.O. 2001, c.25, the Regional Corporation may pass a by-law respecting encroachments on Regional roads;

AND WHEREAS the Council of the Regional Corporation has by resolution passed on the 19th day of April, 2007 authorized the enactment of a by-law authorizing the encroachment;

NOW THEREFORE the Council of the Regional Corporation enacts as follows:

  1. That 656731 Ontario Limited is hereby authorized to maintain the encroachments upon the public highway known as Regional Road 17 (Cawthra Road), as described herein and in accordance with the terms and conditions contained in the Encroachment Agreement dated the 23rd day of February, 2007 between The Regional Municipality of Peel and 656731 Ontario Limited and as shown on Landscape Plan L-1 revision 3 dated April 24, 2006, project # 06-127 prepared by Terraplan Landscape Architects Inc. and filed in Region of Peel Real Estate File ENC-07030.00.

  2. That Schedule "A" attached to this by-law is included and shall be considered part of this By-law.

  3. That the Encroachment Agreement be executed on behalf of the Regional Corporation by the Commissioner of Corporate Services and the Regional Clerk and the corporate seal affixed thereto.
