THE REGIONAL MUNICIPALITY OF PEEL
 
BY-LAW NUMBER 9-2008
 

A by-law to stop-up, close, and deprive of its character as part of the public highway those lands described as Part of Lot 71, Plan 778, City of Mississauga, formerly Township of Toronto, Regional Municipality of Peel, identified as Parts 24 and 25 on Reference Plan 43R-709.

 

WHEREAS the lands described in Schedule “A” to this by-law (the “Subject Lands”) are part of the Regional Road system and the Regional Corporation has jurisdiction over the subject lands pursuant to Section 52(3) of the Municipal Act, 2001, S.O. 2001, c.25 (the “Municipal Act”);

AND WHEREAS the Council of the Regional Corporation pursuant to its authority under the Municipal Act has determined that the Subject Lands may be closed;

AND WHEREAS the closure of the Subject Lands does not require any of the consents in Section 34(2) of the Municipal Act;

AND WHEREAS notice of the proposed by-law was given in accordance with Regional Policy;

AND WHEREAS it is the intention of the Regional Corporation to transfer the Lands to be Transferred;

NOW THEREFORE the Council of the Regional Corporation enacts as follows:

  1. That those parts of the public highway described in Schedule “A” attached hereto being the Subject Lands, be and the same are hereby stopped-up, closed and deprived of their character as a public highway or street.


READ THREE TIMES AND PASSED IN OPEN COUNCIL this 24th day of January, 2008.
