A by-law to amend By-law Number 112-2005 being a by-law to authorize construction of a sanitary sewer on Cawthra Road, in the City of Mississauga, Ward 4. |
WHEREAS, the Council of the Regional Corporation on 15th December, 2005 passed By-Law Number 112-2005 to authorize construction of a sanitary sewer on Cawthra Road and to impose a waterworks rate on the owners of properties abutting the works and which by-law is hereinafter referred to as “the by-law”;
AND WHEREAS the Council of the Regional Corporation has by resolution passed on the 10th September, 2009 authorized the enactment of a by-law to amend the by-law with respect to the rate per metre of assessable frontage;
NOW THEREFORE, the Council of the Regional Corporation enacts as follows:
1. That By-law Number 112-2005 is hereby amended by deleting Section 4 (b) and substituting the following therefore:
“4 b) The amount of $70,549.00, being the property owners’ share of the total cost of the Works shall be recovered by means of a special assessment against the owners of lands abutting the Works as set out in Schedule A attached hereto, at a rate of $215 per metre of assessable frontage up to a maximum of 61 metres of assessable frontage per property payable over fifteen (15) years, plus imputed interest, as certified by the Treasurer.”
2. That By-law Number 112-2005 is hereby amended by deleting Section 5 and substituting the following therefore:
“5. That an annual waterworks rate, based on a frontage rate of $215 per metre to a maximum of 61 metres per lot, payable over fifteen (15) years, plus imputed interest, as certified by the Treasurer, shall be due and payable on lots for which a deferred benefit accrues as soon as an immediate benefit is delivered.”
