THE REGIONAL MUNICIPALITY OF PEEL
 
BY-LAW NUMBER 2-2009
 

A by-law to provide for the Regional Corporation’s consent to permit an encroachment onto parts of Regional Road 107 ( Bovaird Drive) in the City of Brampton.


WHEREAS 1238177 Ontario Inc., the owner of the lands and premises described as Part of Block I, Registered Plan 43M-286, City of Brampton (formerly Township of Chinguacousy), Regional Municipality of Peel, being more particularly identified as Part 1 on Expropriation Plan PR836029 has requested permission to maintain and use certain structures or improvements upon the public highway (the “encroachment”);

AND WHEREAS pursuant to Section 11(3) of the Municipal Act, 2001, S.O. 2001, c.25, the Regional Corporation may pass a by-law respecting encroachments on Regional roads;

AND WHEREAS the Council of the Regional Corporation has by resolution passed on the 22nd day of January, 2009 authorized the enactment of a by-law authorizing the encroachment;

NOW THEREFORE the Council of the Regional Corporation enacts as follows:

  1. That 1238177 Ontario Inc. is hereby authorized to maintain the encroachments upon the public highway known as Regional Road 107 (Bovaird Drive), as described herein and in accordance with the terms and conditions contained in the Encroachment Agreement attached as Schedule “A” dated the 10th day of November, 2008 between The Regional Municipality of Peel and 1238177 Ontario Inc., and shown on a drawing filed in Region of Peel Real Estate File ENC-08167.00.

  2. That Schedule “A” attached to this by-law is included and shall be considered part of this By-law.

  3. That the Encroachment Agreement be executed on behalf of the Regional Corporation by the Deputy Clerk.
