WHEREAS, on June 17, 2005 the Government of Canada, Ontario and Ontario municipalities as represented by AMO, and the City of Toronto executed the Agreement for the Transfer of Federal Gas Tax Revenues under the New Deal for Cities and Communities Between Canada-Ontario-AMO-City of Toronto (referred to herein as the "GTF Agreement");

AND WHEREAS, in September 2008 the Government of Canada, Ontario and Ontario municipalities as represented by AMO, and the City of Toronto amended the GTF Agreement in order to confirm municipalities’ Gas Tax Fund Allocations to 2014;

AND WHEREAS, The Regional Municipality of Peel and AMO have previously entered into a Municipal Funding Agreement for the Transfer of Federal Gas Tax Revenues Under the New Deal for Cities and Communities, included as Schedule A of this by-law (referred to herein as the “MFA”);

AND WHEREAS, The Regional Municipality of Peel has been allocated a total of $142,258,993.52 over the life of the amended GTF Agreement to be paid as follows:

AND WHEREAS, the amended GTF Agreement requires The Regional Municipality of Peel to execute an Amending Agreement to the MFA with AMO, included as Schedule B of this by-law agreeing to comply with all its terms and conditions;

AND WHEREAS, AMO has produced the Amending Agreement to the MFA and requires its execution and return prior to the release of the federal gas tax funds to The Regional Municipality of Peel;

NOW THEREFORE, the Council of the Regional Corporation hereby authorizes the Regional Chair and Regional Clerk to execute the Amending Agreement for the Transfer of Federal Gas Tax Revenues under the New Deal for Cities and Communities between the Association of Municipalities of Ontario and The Regional Municipality of Peel as in Schedule B attached hereto.

And further that Schedules A and B attached hereto shall form part of this by-law.
