THE REGIONAL MUNICIPALITY OF PEEL
 
BY-LAW NUMBER 43-2010
 

A by-law to amend By-law 91-2007 titled “A by-law to regulate the collection of waste in the Region of Peel”.


WHEREAS on August 2, 2007, the Council of The Regional Municipality of Peel enacted By-law 91-2007 to regulate the collection of waste in the Region of Peel and to repeal By-laws 33-2002 and 41-2005;

AND WHEREAS, the Council of the Regional Corporation on January 24, 2008 authorized the enactment of By-law 17-2008 to amend By-law 91-2007;

AND WHEREAS, the Council of the Regional Corporation on June 4, 2009 authorized the enactment of By-law 48-2009 to further amend By-law 91-2007;

AND WHEREAS, under subsection 11(3) of the Municipal Act, S.O. 2001, c. 25, as amended, the Council may pass by-laws respecting waste management, under the jurisdiction of the Region;

AND WHEREAS, the Council of the Regional Corporation has by resolution passed on the 3rd day of June, 2010, authorized the enactment of a by-law to amend By-law 91-2007 to correspond with Resolution 2010-30 to ban the curbside collection of Waste Electrical and Electronic Equipment;

NOW THEREFORE, the Council of the Regional Corporation enacts the following amendments to By-law 91-2007:

1. Definitions 2.53 through Definition 2.57 are amended by renumbering 2.54 through 2.58 consecutively and Definition 2.53 is added by inserting a new definition, Waste Electrical and Electronic Equipment:

“2.53 Waste Electrical and Electronic Equipment means the waste electrical or electronic equipment referred to in Schedule “G”, as designated by the Waste Diversion Act under the Ontario Electronic Stewardship and/or by the Commissioner.”

2. Schedule A to By-law 91-2007, Special Collection Services (Bulky Items), is hereby deleted in its entirety and replaced with an amended Schedule A in the form attached hereto as Schedule A to this by-law.

3. Schedule G to By-law 91-2007, Non-Complying Waste, is hereby deleted in its entirety and replaced with an amended Schedule G in the form attached hereto as Schedule B to this by-law.

Schedule A to
By-law Number 43-2010

 

Special Collection Services (Bulky Items)

Bulky items include:

(i) Barbecues;

(ii) Carpets (tied in compact bundles no larger than 1.2 m (4 ft) in length and 0.76 m (2.5 ft) in width);

(iii) Furniture;

(iv) Mattresses;

(v) Microwave ovens; and

(vii) Rugs

Bulky items do not include:

(i) Propane barbecue tanks;

(ii) Small appliances; and

(iii) Television sets.

 

 

Schedule B to
By-law Number 43-2010

 

Non-Complying Waste:

(i) Liquid waste;

(ii) Hay, straw, manure or waste from any animal, save and except for waste from household pets;

(iii) Industrial, Commercial or Institutional Waste;

(iv) Waste generated as a result of construction, demolition or renovation, including but not limited to soil, sod, plaster, drywall, masonry and tile, bricks, concrete, concrete or cinder blocks, paving stones, asphalt, wood, windows and window glass, shingles, scrap metal, insulation (such as fiberglass or Styrofoam), asbestos, and urea formaldehyde. Hot ashes or other waste capable of starting fires;

(v) Hazardous waste;

(vi) Pathological waste;

(vii) Bio-medical waste, including syringes, hypodermic needles, sharps and medical dressings;

(viii) Automotive parts including tires;

(ix) Waste which has not been drained of liquids;

(x) Dead animals; and

(xi) Waste Electrical and Electronic Equipment, including desktop computers, portable computers, computer peripherals, monitors, televisions, printing devices, modems, telephones and accessories, cellular telephones and accessories, scanners, copiers and typewriters, equalizers and (pre)amplifiers, cameras, Personal Digital Assistants (PDAs) and pagers, audio and video players, personal handheld computers, radios, receivers, speakers, tuners, turntables, video players/projectors and video recorders.

But does not include Home Health Care Waste and Wood Waste that has been broken down and Set Out as a Wood Waste Unit.
