A by-law to approve the expropriation of land being Part of Block H, Registered Plan 636, City of Brampton, Regional Municipality of Peel, being more particularly identified as Parts 1, 2, 4, 6, 7, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20 and 21 on Reference Plan 43R-33898. |
WHEREAS the Council of the Regional Corporation enacted By-law Number 59-2011 on May 26, 2011 authorizing commencement of the expropriation of the above-described lands for the purposes set out therein;
AND WHEREAS, no hearing of necessity has been requested in respect of this proposed expropriation, and the Regional Corporation now seeks approval of the proposed expropriation;
AND WHEREAS, the Council of the Regional Corporation has by resolution passed on September 8, 2011 authorized the approval of the expropriation of the above-described lands;
NOW THEREFORE the Council of the Regional Corporation enacts as follows:

CERTIFICATE OF APPROVAL
IN THE MATTER OF AN APPLICATION BY
The Regional Municipality of Peel
(expropriating authority)
For approval to expropriate land being Part of Block H, Registered Plan 636, City of Brampton, Regional Municipality of Peel, being more particularly identified as Parts 1, 2, 4, 6, 7, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20 and 21 on Reference Plan 43R-33898.
For the purpose of the acquisition of the fee simple interest in land required for the Steeles Avenue and Dixie Road intersection improvements in the City of Brampton and works ancillary thereto, and for a permanent easement in, under, over, through, across, along and upon the lands for the purpose of constructing storm sewers and drains and all related appurtenances and accessories thereto, including the accommodation, construction, installation, operation, maintenance, inspecting, alteration, removal, replacement, reconstruction, relocation, enlargement or repair of storm sewers and drains and all related appurtenances and accessories thereto, and for a permanent easement in, under, over, through, across, along and upon the lands for the purpose of constructing traffic signals and all related appurtenances and accessories thereto, including the accommodation, construction, installation, operation, maintenance, inspecting, alteration, removal, replacement, reconstruction, relocation, enlargement or repair of traffic signal poles, loop detectors, underground wiring and all related appurtenances and accessories thereto, and for a permanent easement or rights in the nature of a permanent easement in, under, over, through across, along and upon the lands for the purposes of constructing road works, including the accommodation, construction, installation, operation, maintenance, inspecting, alteration, removal, replacement, reconstruction, relocation, enlargement or repair of electricity transmission/distribution line or lines, and all related appurtenances and accessories thereto, and for a temporary easement for a term of three years commencing on registration of the expropriation plan on, over, under and through the lands for the purpose of entering upon and occupying the land with all necessary vehicles, machinery, equipment and material required to construct, enlarge, and repair storm sewers and drains and works ancillary thereto.

Temporary Easement
Part of Block H, Registered Plan 636, City of Brampton, Regional Municipality of Peel, being more particularly identified as Part 2 on Reference Plan 43R-33898
being the lands described in the application.
