THE REGIONAL MUNICIPALITY OF PEEL
 
BY-LAW NUMBER 129-2011
 

A by-law to authorize the construction of a watermain on Willow Lane in the City of Mississauga, and undertake such work as a local improvement.


WHEREAS the owners of properties along Willow Lane, from 1125 Willow Lane to 1155 Willow Lane in the City of Mississauga, as set out in Schedule “A” to this by-law, have petitioned for the construction of a watermain which abuts three properties and extends from the intersection of Old Derry Road and Historical Trail northerly to 1125 Willow Lane and westerly to 1155 Willow Lane (approximately 135 meters) in the City of Mississauga (the “Works”);

AND WHEREAS, the Regional Clerk has certified that the petition for undertaking the Works is sufficient pursuant to the requirements set out in Ontario Regulation 586/06 Local Improvement Charges - Priority Lien Status, under the Municipal Act, 2001 (the “Regulation");

AND WHEREAS, notice of the Region of Peel’s intention to pass a by-law to undertake the Works as a local improvement at the meeting of Regional Council on October 13, 2011, was provided in accordance with section 4 of the Regulation;

AND WHEREAS, the Council of the Regional Corporation has by resolution passed on the 22nd day of September, 2011 authorized the construction of the Works under Capital Project 11-1701;

NOW THEREFORE, the Council of the Regional Corporation enacts as follows:

1. The Regional Corporation shall undertake the Works as a local improvement for the purpose of raising one hundred percent of the cost of the Works by imposing special charges on lots abutting on the Works and/or immediately benefiting from the works in accordance with the provisions set out in the Regulation.

2. The Commissioner of Public Works or the consulting engineer for the Regional Corporation shall take such action as may be necessary for the preparation of a contract or contracts for the execution of the Works under their supervision;

3. The estimated total cost of the Works is $146,510.00 (plus applicable taxes) of which $146,510.00 (plus applicable taxes) shall be the owners’ share and $00.00 shall be the Regional Corporation’s share.

4. Pursuant to the Regulation, the total cost of the Works shall be financed as follows:

a) the owners' share of the cost, being the sum of $823.55 per metre of assessable frontage, shall be specially charged upon the land abutting directly on the Works and/or immediately benefiting from the Works as set out in Schedule “A” attached hereto; and

b) The owners’ portion of the cost, $146,510 (excluding applicable taxes) under Capital Project 11-1701, shall be established as an external recovery and collected as a special charge on owners’ tax bills as per O.Reg 586/06; The amount represents the total assessed frontage of 177.90 meters (583.66 feet) as indicated in Schedule A, at $823.55 per metre.
