THE REGIONAL MUNICIPALITY OF PEEL
 
BY-LAW NUMBER 112-2013
 

A by-law to provide for the Regional Corporation’s consent to permit an encroachment onto parts of Regional Road 6 (Queen Street West) in the City of Brampton.


WHEREAS, Eduardo Amaral, the owner of the lands and premises described as Part of Lot 5, Concession 3 West of Hurontario Street, City of Brampton (formerly Township of Chinguacousy), Regional Municipality of Peel, designated as Part 1 on Reference Plan 43R-33499, save and except Part 1 on Expropriation Plan PR2223981, has requested permission to maintain and use certain structures or improvements upon the public highway (the “Encroachment”);

AND WHEREAS, pursuant to Section 11(3) of the Municipal Act, 2001, S.O. 2001, c.25, the Regional Corporation may pass a By-law respecting encroachments on Regional roads;

AND WHEREAS, the Council of the Regional Corporation has by resolution passed on the 28th day of November, 2013 authorized the enactment of a by-law authorizing the encroachment;

NOW THEREFORE, the Council of the Regional Corporation enacts as follows:

  1. Eduardo Amaral is hereby authorized to maintain the encroachments upon the public highway known as Regional Road 6 (Queen Street West), as described herein and in accordance with the terms and conditions contained in the Encroachment Agreement attached as Schedule “A” dated the 14th day of June, 2013 between The Regional Municipality of Peel and Eduardo Amaral, and shown highlighted in yellow on Plan No. 59 prepared by AECOM Canada Ltd. dated FEB 2011 and retained in Region of Peel Real Estate File EXP-11137.04 with the Region.

  2. That Schedule “A” attached to this By-law is included and shall be considered part of this By-law.

  3. That the Encroachment Agreement be executed on behalf of the Regional Corporation by the Regional Clerk.
