THE REGIONAL MUNICIPALITY OF PEEL
 
BY-LAW NUMBER 26-2013
 

A by-law to provide for the Regional Corporation’s consent to permit an encroachment onto parts of Regional Road 15 (Steeles Avenue) in the City of Brampton.


WHEREAS The Corporation of the City of Brampton, the owner of the lands and premises described as Part Lot 1, Concession 1, West of Hurontario Street, City of Brampton (formerly Township of Chinguacousy), Regional Municipality of Peel, designated as Parts 1, 2, and 3 on Reference Plan 43R-32778, has requested permission to maintain and use certain structures or improvements upon the public highway (the “encroachment”);

AND WHEREAS pursuant to Section 11(3) of the Municipal Act, 2001, S.O. 2001, c.25, the Regional Corporation may pass a By-law respecting encroachments on Regional roads;

AND WHEREAS the Council of the Regional Corporation has by resolution passed on the 28th day of February, 2013 authorized the enactment of a by-law authorizing the encroachment;

NOW THEREFORE, the Council of the Regional Corporation enacts as follows:

  1. The Corporation of the City of Brampton is hereby authorized to maintain the encroachments upon the public highway known as Regional Road 15 (Steeles Avenue), as described herein and in accordance with the terms and conditions contained in the Encroachment Agreement attached as Schedule “A” dated the 28th day of February, 2013 between The Regional Municipality of Peel and The Corporation of the City of Brampton, and shown on drawing #A1.1a prepared by Moffat and Duncan dated March 9, 2011 and retained in Region of Peel Real Estate File ENC-2011040.

  2. That Schedule “A” attached to this By-law is included and shall be considered part of this By-law;

  3. That the Encroachment Agreement be executed on behalf of the Regional Corporation by the Regional Clerk;
