WHEREAS, The Corporation of the Town of Caledon, the owner of the lands and premises described as Part of Lots 18, 19 and Not Numbered Lot, Block 4, Registered Plan BOL-7 and Part of Lot 9, Concession 6, Town of Caledon (formerly Township of Albion), Regional Municipality of Peel, designated as Parts 1, 2, 3, 4, 5 and 6 on Reference Plan 43R-33015, save and except Parts 14, 15, 16 and 18 on Reference Plan 43R-33174, Parts 1, 2 and 6 on Reference Plan 43R-33260 and Part 1 on Reference Plan 43R-30748, has requested permission to maintain and use certain structures or improvements upon the public highway (the “encroachment”);

AND WHEREAS, pursuant to Section 11(3) of the Municipal Act, 2001, S.O. 2001, c.25, the Regional Corporation may pass a By-law respecting encroachments on Regional roads;

AND WHEREAS, the Council of the Regional Corporation has by resolution passed on the 11th day of April, 2013 authorized the enactment of a by-law authorizing the encroachment;

NOW THEREFORE, the Council of the Regional Corporation enacts as follows:

1. The Corporation of the Town of Caledon is hereby authorized to maintain the encroachments upon the public highway known as Regional Road 50 (Highway 50/Queen Street North), as described herein and in accordance with the terms and conditions contained in the Encroachment Agreement attached as Schedule “A” dated the 21st day of March, 2013, between The Regional Municipality of Peel and The Corporation of the Town of Caledon, and shown on drawing number L-1A prepared by AECOM and retained in Region of Peel Real Estate File ENC-13017 with the Region;
   
   
2. That Schedule “A” attached to this By-law is included and shall be considered part of this By-law;
   
   
3. That the Encroachment Agreement be executed on behalf of the Regional Corporation by the Regional Clerk;
