WHEREAS Riotrin Properties (Brampton) Inc., the owner of the lands and premises described as Part Lots 11 and 12, Concession 3, East of Hurontario Street, City of Brampton (formerly Township of Chinguacousy), Regional Municipality of Peel, designated as Part of Lots 11 and 12, Concession 3, East of Hurontario Street, City of Brampton (formerly Township of Chinguacousy), Regional Municipality of Peel, designated as Parts 4, 5, 6, 8, 9, 11, 12, 16, 17, 18, 19, 30, 31, 34, 35, 36, and 37 on Reference Plan 43R-23376, save and except for Parts 7, 8, 9, 21, and 22 on Reference Plan 43R-24833, has requested permission to maintain and use certain structures or improvements upon the public highway (the “Encroachment”);

AND WHEREAS pursuant to Section 11(3) of the Municipal Act, 2001, S.O. 2001, c.25, the Regional Corporation may pass a by-law respecting encroachments on Regional roads;

AND WHEREAS the Council of the Regional Corporation has by resolution passed on the 9th day of May, 2013 authorized the enactment of a by-law authorizing the encroachment;

NOW THEREFORE the Council of the Regional Corporation enacts as follows:

1. Riotrin Properties (Brampton) Inc. is hereby authorized to maintain the encroachments upon the public highway known as Regional Road 10 (Bovaird Drive), as described herein and in accordance with the terms and conditions contained in the Encroachment Agreement attached as Schedule “A” dated the 4th day of February, 2013 between The Regional Municipality of Peel and Riotrin Properties (Brampton) Inc., described as Part 1 on Reference Plan 43R-25237 and shown on a drawing filed in Region of Peel Real Estate File ENC-00099.00.
   
   
2. That Schedule “A” attached to this by-law is included and shall be considered part of this By-law.
   
   
3. That the Encroachment Agreement be executed on behalf of the Regional Corporation by the Regional Clerk.
