BY-LAW NUMBER 16-2014 |
A by-law to approve the expropriation of land being Part of Lot 16, Concession 9 Northern Division, City of Brampton (formerly Township of Toronto Gore), Regional Municipality of Peel, being more particularly identified as Parts 1, 2, 3, 4, and 5 on Reference Plan 43R-35531. |
WHEREAS, the Council of the Regional Corporation enacted By-law Number 98-2013 on October 24, 2013 authorizing commencement of the expropriation of the above-described lands for the purposes set out therein;
AND WHEREAS, no hearing of necessity has been requested in respect of this proposed expropriation, and the Regional Corporation now seeks approval of the proposed expropriation;
AND WHEREAS, the Council of the Regional Corporation has by resolution passed on January 23, 2014 authorized the approval of the expropriation of the above-described lands;
NOW THEREFORE, the Council of the Regional Corporation enacts as follows:

Expropriations Act
IN THE MATTER OF an application by
The Regional Municipality of Peel
for approval to expropriate land being:
Part of Lot 16, Concession 9 Northern Division, City of Brampton (formerly Township of Toronto Gore), Regional Municipality of Peel, being more particularly identified as Parts 1, 2, 3, 4 and 5 on Reference Plan 43R-35531.
Located on the west side of The Gore Road, and on the north side of Countryside Drive, in the City of Brampton, Ontario.
For the purpose of widening The Gore Road from north of Castlemore Road to 540 metres north of Beamish Court in the City of Brampton and for works ancillary thereto.
The Council of The Regional Municipality of Peel hereby certifies that approval was given to The Regional Municipality of Peel on the 23rd day of January, 2014 to expropriate the following lands:
Fee Simple
The fee simple interest in the lands described as Part of Lot 16, Concession 9 Northern Division, City of Brampton (formerly Township of Toronto Gore), Regional Municipality of Peel, being more particularly identified as Parts 1, 2, 4 and 5 on Reference Plan 43R-35531.
Temporary Easement
A temporary working easement or rights in the nature of a temporary working easement for a term of three years commencing on registration of the plan of expropriation on, over, under and through the lands described as Part of Lot 16, Concession 9, Northern Division, City of Brampton (formerly Township of Toronto Gore), Regional Municipality of Peel, being more particularly identified as Part 3 on Reference Plan 43R-35531 for the purpose of entering upon and occupying the land with all necessary vehicles, machinery, equipment and material required to facilitate the reconstruction and widening of The Gore Road, grading and other works ancillary thereto.
being the lands described in the application.
