A By-law to provide for the Regional Corporation's consent to permit encroachments onto parts of Regional Road 107 (Bovaird Drive) and Mississauga Road (Regional Road 1), City of Brampton

WHEREAS Calldron Gas Bars Limited, the owner of the lands and premises described as Part of Lot 10, Concession 5 West of Hurontario Street, City of Brampton (formerly Township of Chinguacousy), Regional Municipality of Peel, has requested permission to maintain and use certain structures or improvements upon the public highway ("Encroachment");

AND WHEREAS, pursuant to Section 11(3) of the Municipal Act, 2001, S.O. 2001, c.25, the Regional Corporation may pass a by-law respecting encroachments on Regional roads;

AND WHEREAS, the Council of the Regional Municipality of Peel has by resolution passed on the 10th day of September, 2015 authorized the enactment of a by-law authorizing the Encroachment;

NOW THEREFORE, the Council of the Regional Municipality of Peel enacts as follows:

  1. That Calldron Gas Bars Limited is hereby authorized to maintain the Encroachment upon the public highway known as Regional Road 107 (Bovaird Drive) and Regional Road 1 (Mississauga Road), as described herein and in accordance with the terms and conditions contained in the Encroachment Agreement attached as Schedule "A" dated the 12th day of April, 2015 between The Regional Municipality of Peel and Calldron Gas Bars Limited, and shown on a drawing filed in Region of Peel Real Estate File ENC-02015;

  2. That Schedule "A" attached to this by-law be included and shall be considered part of this By-law;

  3. That the Encroachment Agreement be executed on behalf of the Regional Corporation by the Regional Clerk.
