Chairman L. H. Parsons called the meeting of the Council of the Regional Municipality of Peel to order at 7:30 p.m.

Councillor H. McCallion recited the opening prayer.

All members were present except Councillors Bean, Butt, Raeburn; Councillor Robertson was absent due to a previous commitment; Councillor Spence and Councillor Taylor were absent on other municipal business.

RECOMMENDATION PW-75-78:

That the reconstruction of the Britannia Road - Creditview Road intersection be deferred until 1979 and included with the reconstruction of Britannia Road between Second Line West and the Credit River and the 1978 effort be concentrated on land acquisition and utility relocation particularly at the Creditview intersection. (Project No. 90423-784041).

That resolution 76-75-59 which was approved by Council on March 4, 1976 be amended to include an additional property to receive a 75% partial service reduction from the sanitary sewer local improvement frontage charge, namely; Harrison - 1203 Tecumseh Park Crescent - $603.23 reduction. (Project No. 074031).

That the Region reimburse Lehndorff (Central) Holdings Limited, the amount of $9,474.00 for oversizing of a sanitary sewer required for the future "twinning" of the Etobicoke Creek Trunk Sanitary Sewer, to be financed from Development Funds as per the 1978 Capital Budget, and that a by-law authorizing same be presented to Council. RECOMMENDATION PW-78-78:

That the Chairman and Clerk of the Region of Peel be authorized to execute a quit claim to part of an easement over part of Lot 186, Plan 922, City of Mississauga, in favour of Pei-Hon Henry Chan and Chor Yue Grace Chan, more particularly described as Schedule "A" on the Quit Claim Deed, as requested by the Legal Department of the City of Mississauga;

And further, that the necessary by-law authorizing the Chairman and the Clerk to execute the Quit Claim Deed, be presented to Council.

That the Regional Municipality of Peel Spill Control Contingency Plan for Oil and Other Hazardous Materials be received, and that the role and responsibilities of the Region as described in this plan be approved;

RECOMMENDATION PW-80-78:

That in addition to the compensation for 3.227 acres of land authorized by resolution 78-33-20, Paravon Comlekcier (In Trust) and Iskender Comlekcier (In Trust) be compensated in the amount of $57,607.68 for 0.572 acres of land in part of Lot 1 1, Concession 1 S.D.S., City of Mississauga, and the Property Division be instructed to complete the transaction with the cost thereof being charged to the Cawthra Road, Queen Elizabeth Way to Dundas Street Project, Account Number 90423- 750691;

And further, that all reasonable legal, interest and land transfer tax costs incurred in connection with this transaction be accepted and approved.

RECOMMENDATION PW-81-78:

That Gaetano Fiorino be compensated in the amount of $53,500.00 for the outright purchase of the land and buildings at 1046 Cawthra Road, more particularly described as Lots 17 and 18 on Plan B- l9, City of Mississauga, required in connection with the future construction of Cawthra Road and the Canadian National Railway Underpass;

And further, that the Agreement of Purchase and Sale be accepted and approved and the conditions listed therein be complied with and the Property Division be instructed to complete the transaction with the cost thereof being charged to Account No. 78-4030;

And further, that all reasonable legal and appraisal fees and land transfer tax costs incurred in connection with this transaction be accepted and approved; and that the necessary by-law authorizing the Chairman and Clerk to execute the Agreement of Purchase and Sale document be presented to Council.

RECOMMENDATION PW-82-78:

That the Consumers Gas Company be compensated in the amount of $7,010.00 for 0.0876 acres of land being part of Block I, Plan 636, City of Brampton, shown as Part 1 on Reference Plan 43R-56 1 1, required in connection with the widening of the Canadian National Railway right-of-way at the Steeles Avenue grade separation, that the Agreement be accepted and approved and the Property Division be instructed to complete the transaction with the cost thereof being charged to Project No. 750531;

And further, that all reasonable legal and appraisal fees and land transfer tax costs incurred in connection with this transaction be accepted and approved and the necessary by-law authorizing the Chairman and the Clerk to execute the Offer to Sell document be presented to Council.

That Elmore A. G. English be compensated in the amount of $10,500 for 1486 square feet of land, being part of Lot 26, Registered Plan 537, in the City of Mississauga, shown as Part 14 on Reference Plan 43R-4071, required in connection with the widening and reconstruction of Cawthra Road between the Queen Elizabeth Way and Dundas Street, that the Agreement be accepted and approved and the Property Division be instructed to complete the transaction with the cost thereof being charged to the Cawthra Road Project, No. 750691;

And further, that all reasonable legal and appraisal fees and land transfer tax costs incurred in connection with this transaction be accepted and approved and that the necessary by-law authorizing the Chairman and Clerk to execute the Offer to Sell document be presented to Council.

RECOMMENDATION PW-84-78:

That Ontario Hydro be compensated in the amount of $2,790.00 for a permanent easement over part of Lot 8, Range 2, C.I.R., in the City of Mississauga, shown as Part 2 on Reference Plan 43R-4867, required in connection with the construction of the Mississauga Crescent Sanitary and Storm Sewer, that the Agreement be accepted and approved and the cost thereof being charged to the Sewer Construction Project, 904-33-710077202, with the agreement of the City of Mississauga to share equally the land acquisition costs;

And further, that all reasonable legal, appraisal fees and land transfer tax costs incurred in connection with this transaction be accepted and approved, and the necessary by-law authorizing the Chairman and Clerk to execute the Agreement and Title documents, as required, on behalf of the Region of Peel, be presented to Council.

RECOMMENDATION PW-85-78:

That Ontario Hydro be compensated in the amount of $173,345.97 for 3.556 acres of land being part of Lots 6, 7, 8 and 10, Concession 1, S.D.S. and part of Lots 27 and 28, Registered Plan G-14, in the City of Mississauga, shown as Parts 1 to 7, inclusive, Parts 10 to 15, both inclusive, Parts 28 to 31, both inclusive and Parts 35, 36 and 37, all on Reference Plan 43R-391, required in connection with the Queensway Extension, Cawthra Road to Dixie Road;

And further, that the Agreement and the conditions outlined therein be accepted and approved and the Property Division be instructed to complete the transaction with the cost thereof being charged as follows: Project No. 750591- $162,751.30; Project No. 764040 - $10,594.67;

And further, that all reasonable legal, appraisal fees and land transfer tax costs incurred in connection with this transaction be accepted and approved and the necessary by-law authorizing the Chairman and Clerk to execute the Agreement and Title documents, as required, on behalf of the Region of Peel, be presented to Council.

RECOMMENDATION PW-86-78:

That the Offer to Purchase received from Yianoulla M. Headford, in the amount of $3,900.00 for an area of land abutting Lot 14, Registered Plan Number 413, in the City of Mississauga, containing 9,439 square feet, subject to an easement in favour of the Region, described as Part 5 on Reference Plan 43R-3902, shown as Parts 4 and 5 on Plan 43R-3902, be accepted and approved and the Property Division be instructed to complete the transaction crediting revenue from the sale to Miscellaneous Land Acquisition Account 90423-784030;

And further, that all reasonable legal fees incurred in connection with this transaction be accepted and approved and the necessary by-law authorizing the Chairman and Clerk to execute the Offer to Purchase and Title documents, as required, be presented to Council.

RECOMMENDATION PW-87-78:

That the Ministry of Transportation and Communications be notified that it is the Region of Peel's preference to have both the road name and number signed at the intersection of King's Highways and Regional Roads;

And further, that the Area Municipalities be encouraged to provide names for Regional Roads where none exist.

RECOMMENDATION PW-88-78:

That the proposal as received from Gore and Storrie Limited dated March 31, 1978, for the study of a Supervisory Control System for the small water systems in Caledon be accepted at an upset limit of $10,000.00 and that the Chairman and Clerk be authorized to execute the necessary Engineering Agreements with Gore and Storrie Limited;

And further, that the funds in the amount of $10,000.00 be financed from Current Budget Account No. 703-8100-3709.

RECOMMENDATION PW-89-78:

That permission be granted to the Consumers' Gas Company to have the right of ingress and egress to construct, survey, lay, use, inspect, remove, renew, replace, alter, reconstruct, repair, operate and maintain a gas pipeline over lands on which the Region of Peel and the City of Mississauga have a 66 foot easement, as requested by the legal firm of Aird & Berlis, solicitors for Consumers' Gas Company, and that the necessary by-law authorizing the Chairman and Clerk to execute the Agreement be presented to Council.

That a by-law be presented to Council authorizing the Chairman and the Clerk to execute an agreement with the City of Mississauga regarding the reconstruction of Second Line West between Eglinton Avenue and Britannia Road as attached to the report of the Commissioner of Public Works dated April 11, 1978.

SS-78-5 - SOCIAL SERVICES meeting April 18, 1978

CW-42-78:

That the Region approve the rate of $12.35 per visit requested by the Peel Branch of the Victorian Order of Nurses for 1978, on condition that they agree to apply any 1978 surplus to their 1979 budget prior to setting the rate per visit for that year.

RECOMMENDATION SS-14-78:

That the Central Mortgage and Housing Corporation be requested to review jointly with the Ministry of Housing those concerns raised in the report of the Commissioner of Social Services dated March 31, 1978 regarding the Assisted Home Ownership Programme in Peel and to provide to Peel an action plan as to how personal tragedies may be avoided;

And further, that the press and the owners of the product being advertised in the newspapers be requested to review their advertising policies insofar as housing is concerned with particular emphasis on very liberal promises that evidently or apparently hold out false hope to the gullible buyer;

And further, that the Real Estate Boards be requested to address the ethics of the situation and to develop a program that will help potential buyers to avoid personal tragedies wherever possible;

And further, that the Federal Ombudsman and the Provincial Ombudsman be requested to review this program and to advise Regional Council in due course of their concept of the problem.

RECOMMENDATION SS-15-78:

That Dr. John Tracy be appointed Home Physician for Peel Manor Home for the Aged commencing May 1, 1978;

And further, that the necessary by-law to authorize the execution of an agreement with Dr. John Tracey with respect to his appointment be presented to Council.

P-78-7 - PLANNING meeting April 20, 1978

RECOMMENDATION P-75-78:

This recommendation was amended to read:

"That the Regional Planning Department staff and the Regional Solicitor be authorized to attend the Ontario Municipal Board hearing with respect to the referral under Section 17 (3) and the restricted area (zoning) appeal under Section 35 (22) of The Planning Act by Dalewood Investments Limited and;

(a) that the Board be advised of the serious concerns over enrolment expressed by the Roman Catholic Separate School Board and be requested to obtain a current appraisal of the situation from the School Board prior to making its decision;

(b) that in the event the Board indicates its intent to approve the subject applications:

(i) conditions be requested requiring an agreement to be entered into for the payment of Regional levies; and

(ii) that the Board be requested to amend the format of the proposed by-law to incorporate design guidelines required by the City of Mississauga under Section 35(a) of The Planning Act. "

RECOMMENDATION P-76-78:

That the Ministry of Housing be advised that the Region of Peel has no objections to the approval of Amendment 279 to the Official Plan for the City of Mississauga Planning Area with respect to lands at the south-east corner of Darcel Avenue and Morning Star Drive subject to the provision of a clause to require that prospective purchasers be advised of the existence of the future Highway Number 427 and the anticipated noise levels associated with that roadway and further that this notification be registered on title;

And further, that a copy of the Commissioner of Planning's report dated March 31, 1978 concerning Amendment 279 be forwarded to the City of Mississauga, the Ministry of Housing and the Ontario Municipal Board for information;

And further, that no Regional levies be payable with respect to this development.

RECOMMENDATION P-77-78:

That the Ministry of Housing be advised that the Region of Peel has no objections to the release of the subject lands under application MISS-69, with respect to lands on the east side of Cawthra Road opposite Hamilton Avenue in the City of Mississauga from the Ontario Regulations made under the Parkway Belt Planning and Development Act;

And further, that a copy of the report of the Commissioner of Planning dated April 6, 1978 be forwarded to the Ministry of Housing and the City of Mississauga for their information.

RECOMMENDATION P-78-78:

This recommendation was amended to read:

"That the Ministry of Housing be advised with respect to draft plan of subdivision 21T-74094 which has been referred to the Ontario Municipal Board under Section 44(1) of The Planning Act that the Region of Peel has no objections to the approval of the plan subject to the following conditions:

1. that an Engineering Agreement be entered into between the Region of Peel, the City of Mississauga and the Developer prior to the registration of the plan to establish exact requirements for the servicing and orderly development of the site;

2. that a Financial Agreement be entered into between the Region of Peel, the City of Mississauga and the Developer prior to the registration of the plan to provide for the payment of Regional levies and other financial matters relating to this development, in a form satisfactory to the Region;

And further, that the Regional Solicitor and the Planning staff be authorized to attend the future Ontario Municipal Board hearing(s) to give evidence as required in support of the Region's requirements which are outlined in this report;

And further, that a copy of the Ministry of Housing's questionnaire forms Vl and Tla as completed by the Region of Peel and the City of Mississauga be forwarded to the Ministry of Housing together with a copy of the Regional Commissioner of Planning's report dated April 14, 1978 and the City of Mississauga's consolidated report dated April 4, 1978 and revised draft plan dated February 20, 1978. "

RECOMMENDATION AF-70-78:

That the Board of Commissioners of Police be requested to approve in principle the action of Regional Council in approaching the Provincial Government to request a review of the annual Police Unconditional Grant.

That the balance of the 1977 Surplus on Regional consolidated operations, in the amount of $652,185.00, be allocated as follows:

a) $100,000.00 be transferred to the General Contingency Provision to offset recent increases in Ontario Health Insurance Program premiums;

b) $552,185.00 be transferred to the Reserve for Working Funds.

That Regional Council confirm the present Regional Development Levy Policy with respect to land severances;

And further, that the Regional Chairman be requested to reply to the resolution of the Peel Federation of Agriculture in accordance with the draft letter attached to the report of the Chief Administrative Officer dated February 17, 1978.

That the Region of Peel offer no objections to City of Mississauga By-law 127-78 at the Ontario Municipal Board;

GR-78-2 - GRANTS REVIEW meeting April 20,1978

RECOMMENDATION GR-20-78:

This recommendation was amended to read:

"That Regional Council provide a grant of $5,000.00 on a one-time-only basis to the Malton Community Council, subject to receipt by the Malton Community Council of the following funds from external sources:

Provincial Ministry of Culture & Recreation $16,640.00
United Way $ 4,990.00
Special Campaign and Events $ 3,125.00


And further, that the Malton Community Council work with the Peel Social Planning Council to develop goals and objectives and to devise a system whereby any future requests for funds can be measured objectively by deeds done;

And further, that the Board of Directors of the Malton Community Council address more vigorously in 1978 its fund raising role apart from government programs in order to stabilize its future financial base;

And further, that the Malton Community Council not attempt to enter into or duplicate service programs simply because of language or cultural difficulties but rather utilize its staff/volunteers to reinforce existing agencies to help those persons needing support programs;

And further, that the Malton Community Council staff be multi-lingual to cover, to the greatest extent possible, the great number of ethnic persons residing in Malton."

That the Commissioner of Social Services be requested to report to the next Grants Review Subcommittee meeting regarding the request of Peel Family Services for an additional $10,400.00 in the purchase-of-service agreement between the Region and Peel Family Services.

h) A report of the Commissioner of Social Services regarding an increase in rates for the Victorian Order of Nurses, was considered.

That the 1978 rate of $12.10 per visit approved by Council for 1978 be increased to $12.35 for the period January 1, 1978 to March 31, 1979 as requested by the Victorian Order of Nurses;

And further, that the 1979 rate be determined by taking into full consideration the surplus balance shown in the yearly financial report at the end of 1978;

And further, that a copy of the report of the Commissioner of Social Services dated April 24, 1978 be sent to the Peel Board of Health;

And further, that the rate for 1979 be developed jointly between the Social Service Department and the Peel Board of Health in order to ensure a consistent and fair Regional approach to the rate structure.

That the contract for the construction of the Park Royal sanitary trunk sewer emergency wet weather overflow to Sheridan Creek be awarded to the low bidder, Three Colour Construction Company Limited for their tender price of $25,963.11 and, subject to approval by the Credit Valley Conservation Authority, construction is to commence immediately and be completed by the end of May, and that the Chairman and Clerk be authorized to execute the contract documents. a) A Permission to Enter between the Region of Peel, J.D.S. Investments Limited and the Bank of Nova Scotia, for the purpose of constructing a watermain on lands in part of Lot 14 Range 3 C.I.R., City of Mississauga;

b) An Agreement between the Region of Peel and Dr. John P. Tracey regarding his appointment as Home Physician for Peel Manor Home for the Aged;
