PL-B1. Urban Transportation Showcase Program

RECOMMENDATION GC-159-2003:

That Regional Council receive the Urban Transportation Showcase Program detailed application, dated May 16, 2003, titled "SMART COMMUTE INITIATIVE" as set out in Appendix I to the report of the Commissioner of Planning, dated May 27, 2003, titled "Urban Transportation Showcase Program";

And further, that on behalf of the Region, the Regional Chair send a letter to the Minister of Transportation, Ontario requesting their participation and financial contribution to the "SMART COMMUTE INITIATIVE";

And further, that a copy of the subject report be forwarded to the Greater Toronto Area (GTA) municipal participants and the area municipalities in Peel.

PL-B2. Status Update for the Proposed GO Train Station in Bolton

RECOMMENDATION GC-160-2003:

That the Regional Chair write to the Ontario Minister of Transportation and the Chair of GO Transit requesting them to initiate a feasibility study for commuter rail service to Bolton;

And further, that copies of the subject letter be sent to the Region of York City of Vaughan, City of Brampton, and the Town of Caledon, encouraging them to forward similar letters to the Minister of Transportation and the Chair of GO Transit;

And further, that Real Estate staff be authorized to commence negotiations for the acquisition of an Option to Purchase or other form of Agreement that will secure/protect the future Bolton GO Station site and report back to Regional Council on the conclusion of the said negotiations;

And further, the Town of Caledon be requested to take appropriate action to protect access to the designated GO station location through the planning approval process;

And further, that the report of the Commissioner of Planning, dated May 21, 2003, titled "Status Update for the Proposed Go Train Station in Bolton" be forwarded to the Ontario Ministry of Transportation (MTO), GO Transit, Region of York, City of Vaughan, City of Mississauga, City of Brampton, and the Town of Caledon for their review and consideration.

PL-C. Development Planning Services

PL-C1. Regional Official Plan (ROP) Amendment Proposing to Change ROP Schedule G-High Order Transit Network (File 03-002) - Town of Caledon, Wards 4 and 5

RECOMMENDATION GC-161-2003:

That staff be authorized to schedule and organize a public meeting, pursuant to S. 17(15) of the Planning Act to inform the public and hear views regarding a Regional Official Plan Amendment to change the site of the proposed GO Rail Station from the southeast to the northwest quadrant of the Bolton Rural Service Centre;

And further, that Councillors Whitehead, Palleschi and Harker, be delegated authority to serve as a Committee of Council to hold a statutory public meeting on behalf of Regional Council to receive information regarding a Regional Official Plan (ROP) Amendment to change ROP Schedule G-High Order Transit Network and to satisfy Section 17(15) of the Planning Act;

And further, that the statutory public meeting be held in the Town of Caledon in close proximity to Bolton for the purpose of receiving public comments on a draft amendment to the Region of Peel Official Plan as it relates to the Proposed GO Rail Station in Bolton;

And further, that the report of the Commissioner of Planning, dated May 26, 2003, titled "Regional Official Plan Amendment Proposing to Change ROP Schedule G-High Order Transit Network (File 03-002) - Town of Caledon, Wards 4 and 5" be forwarded to the Ministry of Municipal Affairs and Housing and the Ministry of Transportation, Peel's area municipalities, the City of Vaughan, Region of York and GO Transit for comment;

And further, that staff bring forward a final proposed amendment to the Region of Peel Official Plan (ROP), that takes into consideration the comments received from the statutory public meeting and public agency consultation, for adoption.

PW-A1. Region of Halton Resident Request for Water and Wastewater Service to the West Side of Ninth Line (Between Britannia Road and Derry Road) - City of Mississauga, Ward 9

RECOMMENDATION GC-162-2003:

That the Region of Peel enter into an agreement with the Region of Halton and the property owner for 6314 Ninth Line, Milton, Ontario to provide municipal water and wastewater services to this property;

And further, that the subject property owner be responsible for water and wastewater service construction and for all financial responsibilities, including connection charges, legal disbursements and a system 'buy-in' charge equivalent to the water and wastewater component of the Region of Peel's residential Development Charges By-Law Number 68-1999;

And further, that the subject property be added to the Region of Peel water and wastewater billing system;

And further, that the Regional Municipality of Halton and the subject property owner be so advised;

And further, that the required documents be executed by the Region's duly authorized signing officers.

PW-A4. Speed Limit Review - Re-Evaluation: Regional Road 9 (King Street) West of Duffy's Lane - Town of Caledon, Ward 4

RECOMMENDATION GC-163-2003:

That the existing posted speed limit of 60 km/h on Regional Road 9 (King Street) from Connaught Crescent to a point located 385 metres (1,263 feet) west of Glasgow Road be extended further west to include an additional 780 metres (2,553 feet) of roadway currently posted at 80 km/h, in the Town of Caledon;

And further, that the necessary by-law be presented to Regional Council;

And further, that the Ontario Provincial Police be advised.

PW-A5. Replacement of Three Total Station Survey Instruments, Capital Project 03-9050

RECOMMENDATION GC-164-2003:

That the Region of Peel enter into a Direct Negotiation with Trimble Canada Ltd. for the purchase of three Total Station Survey instruments for a total of $86,955 (excluding applicable taxes) under Capital Project 03-9050 pursuant to Purchasing By-Law Number 62-2001;

And further, that the necessary funds for Capital Project 03-9050 of $100,000 ($86,955 plus applicable taxes) be financed from the Engineering Services Equipment Reserve R2240;

And further, that the required documents be executed by the Region's duly authorized signing officers.

PW-A6. Document No. 2003-067T, Queen Street East Reconstruction and Northeast Brampton Feedermain from West Drive to Airport Road, Capital Projects 01-4030, 02-1970, 03-1105, 03-1490 and 03-1495 - City of Brampton, Wards 7, 8, 9, and 11

RECOMMENDATION GC-165-2003:

That the contract for Queen Street East Reconstruction and the construction of the 2100mm (7ft) diameter Northeast Brampton Feedermain from West Drive to Airport Road, City of Brampton, be awarded to Dufferin Construction Company Limited, in the amount of $36,591,307 (excluding applicable taxes) under Capital Projects 01-4030, 02-1970, 03-1105, 03-1490 and 03-1495 in accordance with Purchasing By-law Number 62-2001;

And further, that additional funding of $3,287,691 be provided to Capital Project 01-4030, funded from the Regional Roads Development Charge Reserve (R3505) subject to these funds being added to the value of works to be recovered from future development charges as outlined in the Development Charges Background Study, dated May 23, 2003;

And further, that additional funding of $169,202 be provided to Capital Project 03-1105, funded from the Regional Water Development Charge Reserve (R3530) subject to these funds being added to the value of works to be recovered from future development charges as outlined in the Development Charges Background Study, dated May 23, 2003;

And further, that additional funding of $87,250 be provided to Capital Project 03-1495, funded from the Water Capital Financing Stabilization Reserve (R0241);

And further, that the required documents be executed by the Region's duly authorized signing officers.

PW-A7. Document No. 2002-328N, Trunk Sewer Inspection and Condition Assessment - Project 03-2530

RECOMMENDATION GC-166-2003:

That the Region of Peel enter into a Direct Negotiation with M.E. Andrews and Associates Limited to carry out inspections, condition assessments and related studies on various major sanitary trunk sewers for the 2003 program for $799,500 (excluding applicable taxes) under Capital Project 03-2530, pursuant to Purchasing By-law Number 62-2001;

And further, that funding of $1,000,000 for the 2003 program be provided to Capital Project 03-2530 from the Wastewater Unallocated Capital Project 02-2000, funded from the Wastewater Capital Financing Stabilization Reserve (R0242);

And further, that staff be authorized to extend the contract in 2004 to M.E. Andrews and Associates Limited to undertake and complete the proposed 2004 program, subject to Council approval of the 2004 Capital Budget, based on satisfactory service, performance and pricing.


PW-B. Water and Wastewater Treatment

PW-B1. Annual Compliance Report: Municipal Water Supplies

RECOMMENDATION GC-167-2003:

Whereas Condition 4 of all Certificates of Approval for municipal waterworks in Ontario requires the waterworks owner to complete an annual Compliance Report detailing compliance with all terms and conditions of the Certificates of Approval;

And whereas each Compliance Report shall be signed by Mitch Zamojc, Commissioner of Public Works, designated by the Council of the municipality that owns the works;

And whereas the owner of the waterworks shall confirm by a Resolution of Council that the Compliance Report has been presented to Council;

Now therefore be it resolved that Regional Council endorse the Annual Water Compliance Report for 2002 to comply with Condition 4.

RECOMMENDATION GC-170-2003:

That the contract for the provision of insurance coverage be awarded to Frank Cowan Company Limited in the total amount of $820,896 for the policy term of insurance from July 1, 2003 to July 1, 2004, exclusive of applicable taxes;

And further, that the required documentation be executed by the Region's duly authorized signing officers.

MA-A3. Funding for Environmental Effectiveness Monitoring Program Associated with the Proposal to Expand the 2021 Regional Urban Boundary to Include the Area Known as Northwest Brampton

RECOMMENDATION GC-171-2003:

That Council endorse the Environmental Effectiveness Monitoring Program as proposed by the Credit Valley Conservation Authority as described in the report of the Commissioners of Planning, Public Works, and Finance, dated May 29, 2003, titled "Funding for the Environmental Effectiveness Monitoring Program Associated with the Proposal to Expand the 2021 Regional Urban Boundary to Include the Area Known as Northwest Brampton";

And further, that funding up to a limit of $80,000 for the work to occur in 2003, be approved subject to the Treasurer and Commissioner of Finance reporting back to Council with the specific funding source for the 2003 works, noting that the total five year program may cost up to $400,000 depending on the final scope of the monitoring program.


MA-A4. 2004 Business Planning Process

RECOMMENDATION GC-172-2003:

That the timeliness for the 2004 Business Planning process set out in the report of the Treasurer and Commissioner of Finance, dated May 28, 2003, titled "2004 Business Planning Process" be approved;

And further, that the subject report be forwarded to the Police Services Board;

And further, that the Police Services Board be requested to submit their budget along with all documentation required for presentation to Council by October 15, 2003.

MA-A5. Funding of Capped Property Tax Increases

RECOMMENDATION GC-173-2003:

That the provincial government be requested to act as expeditiously as possible following consultations with municipalities to introduce legislation to implement the phasing out of property tax capping;

And further, that the by-law which notifies of the amounts of reductions to tax decreases required to fund the capped tax increases of properties in the commercial, industrial and multi-residential classes be presented to Regional Council.

MA-B1. 2003 Triannual Financial Report - April

RECOMMENDATION GC-174-2003:

That $1.17 million in funding be redeployed from the Non-Program budget to a number of program budgets to reflect permanent changes in budget base as follows:

  • Non Program - Contribution to Working Fund Reserve $(1,170,000)
  • Peel Region Police - Employee Post Retirement Benefits $900,000
  • Non Program - Employee Post Retirement Benefits $130,000
  • Assessment Services - $140,000;

And further, that the Ontario Works budget be increased by $0.30 million, which will be fully offset by increased Provincial subsidies of $0.30 million, to allow for the hiring of 5 additional case workers.

MA-C7. News Release: From the Association of Municipalities of Ontario (AMO), dated May 23, 2003 Urging Municipal Action on Referendum Proposal on Municipal Taxation

RECOMMENDATION GC-175-2003:

Whereas the PC Party of Ontario has introduced its election platform which contains a proposal requiring municipalities to hold referendum on future tax increases;

Whereas municipal councils are democratically elected to manage the affairs of their municipality;

And whereas the municipal level of government is best able to understand, balance and meet the complex and long-term needs of a community in an efficient, cost-effective and transparent manner;

And whereas municipalities are already required by law to balance their budgets every year, have legislated accountability measures in place for provincial transfers and municipal performance is measured on an annual basis through the Province's Municipal Performance Measurement Program (MPMP) and the Ontario Municipal Benchmarking Initiative (OMBI);

And whereas municipalities are faced with a number of pressures that impact spending including, but not necessarily limited to:

1. the effect of provincially mandated programs and ever-increasing service requirements and standards which represent a majority of municipal budgets;
2. the limitations of property tax laws themselves which restricts a municipality's ability to redistribute tax burden between classes; and
3. the lack of full control that municipalities have over large portions of their budgets including most boards and agencies which levy costs against municipalities, as well as the pooling of Social Assistance and Social Housing costs within the Greater Toronto Area (GTA).

And whereas municipalities continue to be put in an even more difficult situation to make ends meet without any new substantive sources of revenue;

And whereas this proposal will pose significant challenges to municipal operations and budgets and undermine the autonomy recently established with the government under the new Municipal Act and the Memorandum of Understanding that was developed with the Province;

And whereas the Regional Municipality of Peel is concerned about the implications and workability of any proposal that will require a referendum for approval of any property tax increase;

And whereas neither the Association of Municipalities of Ontario (AMO) nor the municipal sector was consulted on the implications of the proposed referendum on municipalities;

Now therefore be it resolved that the Regional Municipality of Peel requests that the Ontario PC Party recognize that this proposal will have significant consequences and immediately eliminate plans to implement the proposed referendum, and to instead work with the Government of Canada, the Association of Municipalities of Ontario and municipalities to ensure that municipal governments acquire new and significant sources of tax revenue and a true "fair deal for municipalities";

And further, that a copy of this resolution be forwarded to the Premier of Ontario, the Minister of Municipal Affairs and Housing, the Minister of Municipal Affairs and Housing (Urban), the Minister of Municipal Affairs and Housing (Rural), all local MPPs including the Minister of Health and Long Term Care and MPP for Brampton West - Mississauga, the Minister of Citizenship and MPP for Mississauga East, the President of the Conservative Party of Ontario and the Association of Municipalities of Ontario.

F1. Resolution Seeking a Third Regional Representative to be Appointed to the Joint Peel-Caledon Accessibility Advisory Committee (AAC)

RECOMMENDATION GC-176-2003:

That in addition to the Regional Chair as member ex-officio, Councillors Whitehead and Saito be appointed to the Joint Peel-Caledon Accessibility Advisory Committee (AAC) for a term ending November 30, 2003 or until their successors are appointed by Regional Council;
