RECOMMENDATION GC-17-2006:

That the consolidated agenda for the February 9, 2006, General Committee meeting be amended to include a discussion regarding Bill 206, the Ontario Municipal Employees Retirement System (OMERS) Act, 2005, to be dealt with under Other Business ;

And further, that Items Related to Management - Item MA-B2 be brought forward to be dealt with prior to 11:00 a.m.;

And further, that the agenda for the February 9, 2006, General Committee meeting be amended to include a motion from Councillor Fennell regarding the Federal Gas Tax Allocation;

And further, that the consolidated agenda for the February 9, 2006, General Committee meeting be approved, as amended.

MA-B2. Federal Gas Tax Allocation

Councillor Fennell put forward the following motion:

RECOMMENDATION GC-18-2006:

That 100 per cent of the Federal gas tax contribution to the Region of Peel for 2005-2006 be allocated to the local municipalities to fund local transit and transportation;

And further, that the 2005-2006 Federal gas tax contribution to the Region of Peel in the amount of $19.28 million be allocated to the Cities of Brampton and Mississauga and the Town of Caledon as follows:

  City of Brampton
$ 6.34 million
  City of Mississauga
$11.96 million
  Town of Caledon
$ 0.98 million
   
  Total
$19.28 million

And further, that TransHelp, in consultation with the local area municipalities; the medical professionals; the taxi industry and relevant community organizations, undertake the development of a detailed business and operational plan by September, 2006 for consideration by Regional Council in determining the allocation of the 2007-2009 Federal gas tax contribution in 2007;

And further, that future allocation to the local municipalities of the Federal gas tax contribution to the Region of Peel require that the 2006 Census data be used in the calculation of the distribution of funds, as soon as the 2006 Census numbers are released;

And further, that the necessary by-law be presented to Regional Council.

D3. Jim McKibbin, Manager of Communications and Bernadette Arreola, Public Communications Officer, 2006 Census, Emphasizing the Importance of Promoting the 2006 Census in the Region of Peel

Jim McKibbin, Manager of Communications and Bernadette Arreola, Public Communications Officer, 2006 Census, emphasized the importance of all persons residing in Canada being counted in the Census to be held on May 16, 2006 because accurate Census data is crucial to ensuring adequate Provincial and Federal funding for municipalities. Mr. McKibbin advised of strategies which will be used to ensure that persons who do not speak English or French are able to participate in the 2006 Canadian Census.

PW-A1. Regional Road 50 Widening from Queen Street (Regional Road 107) to Castlemore Road/Rutherford Road, Capital Projects 02-4050, 04-1180 and 03-2210, Document 2005-507P - City of Brampton, Ward 10

RECOMMENDATION GC-19-2006:

That Document 2005-507P for detailed design, contract administration and construction supervision services for the improvements on Regional Road 50 from Queen Street (Regional Road 107) to Castlemore Road/Rutherford Road in the City of Brampton, Ward 10, be awarded to URS Canada Incorporated in the estimated amount of $1,361,182 (excluding applicable taxes), under Capital Projects 02-4050 ($921,361), 04-1180 ($67,668), and 03-2210 ($372,153), in accordance with Purchasing By-law 62-2001;

And further, that authority be given to extend this contract for similar or unforeseen requirements to the limit of the approved budget when actual requirements exceed the estimate, subject to disclosure of any such actions undertaken in the regularly scheduled Triannual Report.

PW-A2. Airport Road Widening from Mayfield Road to Approximately 1.3 Kilometres Northerly, Engineering Services Extension, Capital Project 03-4040, Document 2005-173N - Town of Caledon, Ward 2

RECOMMENDATION GC-20-2006:

That the existing contract Document 2005-173N for Engineering Services between the Region of Peel and Giffels Associates Limited for the widening of Airport Road from Mayfield Road to approximately 1.3 kilometres northerly in the Town of Caledon, Ward 2, be extended to provide engineering services for environmental assessment, detailed design, contract administration and construction supervision in the estimated amount of $329,700 (excluding applicable taxes), under Capital Project 03-4040, for a total commitment of $376,600 (excluding applicable taxes), in accordance with Purchasing By-law 62-2001;

And further, that authority be given to extend the contract with Giffels Associates Limited to complete the work related to any additional unforeseen project issues up to the limit of the approved budget, subject to disclosure of any such actions undertaken in the regularly scheduled Triannual Report.

PW-A3. Lift and Dedicate a Portion of 0.3 Metre Reserve, Regional Road 8 (The Gore Road), North of Ebenezer Road - City of Brampton, Ward 10

RECOMMENDATION GC-21-2006:

That a by-law be enacted to lift a portion of the 0.3 metre (1 foot) reserve in the City of Brampton, Ward 10, on the east side of Regional Road 8 (The Gore Road), north of Ebenezer Road to provide one right in / right out access 8.35 metres (27.40 ft) in width to the commercial development, Massi Corner Inc.

PW-A4. Dixie Road Improvements from King Street to Olde Base Line Road, Capital Project 03-4010, Document 2005-471P - Town of Caledon, Wards 1 and 2

RECOMMENDATION GC-22-2006:

That Document 2005-471P for detailed design, contract administration and construction supervision services for the improvements on Dixie Road from King Street to Olde Base Line Road be awarded to Delcan Corporation in the estimated amount of $436,651 (excluding applicable taxes), under Capital Project 03-4010, in accordance with Purchasing By-law 62-2001;

And further, that authority be given to extend this contract for similar or unforeseen requirements to the limit of the clients approved budget when actual requirements exceed the estimate, subject to disclosure of any such actions undertaken in the regularly scheduled Triannual Report.


PW-B. Water and Wastewater Treatment

PW-B1. North Peel Groundwater System Upgrades Project, Capital Projects 04-1810, 02-1880 and 04-1905, Document 2003-668P - Town of Caledon, Wards 1, 2, 3 and 4

RECOMMENDATION GC-23-2006:

That Document 2003-668P for detailed design and contract administration services for Assignment 1 for the North Peel Groundwater System Upgrades Project between the Region of Peel and Earth Tech Canada Incorporated be extended to provide additional engineering services in the estimated amount of $225,846 (excluding applicable taxes), for a new estimated total of $1,657,618.80 (excluding applicable taxes), in accordance with Purchasing By-law 62-2001, broken down as follows: $50,800, under Capital Project 02-1880, $75,046, under Capital Project 04-1905, and $100,000, under Capital Project 04-1810;

And further, that Document 2003-668P for the detailed design and contract administration services for Assignment 2 for the North Peel Groundwater System Upgrades Project between the Region of Peel and Stantec Consulting Limited be extended to provide additional engineering services in the estimated amount of $75,000 (excluding applicable taxes), under Capital Project 04-1810, for a total commitment of $975,364.80 (excluding applicable taxes), in accordance with Purchasing By-law 62-2001.

PW-C. Waste Management

PW-C1. Managed Competition for White Goods Collection, Transportation and Delivery, Document 2005-524T

RECOMMENDATION GC-24-2006:

That the Managed Competition Document 2005-524T, for the collection, transportation and delivery of White Goods in Mississauga and Brampton be awarded to Turtle Island Recycling Corporation for a 10 year period commencing on or about July 1, 2006, for an estimated total first year cost of $452,430 (excluding applicable taxes), in accordance with Purchasing By-law 62-2001;

And further, that staff be authorized to increase and/or extend the contract for similar requirements for this and subsequent periods, where the actual annual or seasonal requirements exceed the estimates to the limits allowed by the budget;

And further, that the existing contract with Waste Management of Canada Corporation, dated April 26, 2005, for the collection of White Goods in the Cities of Mississauga and Brampton be extended from April 1, 2006, on a month-to-month basis, until the commencement of the contract with Turtle Island Recycling Corporation, at an estimated cost of $50,000 per month, based on the terms described in the report of the Commissioner of Public Works, dated January 9, 2006, titled "Managed Competition for White Goods Collection, Transportation and Delivery, Document 2005-524T";

And further, that the required documents be signed by the Regional Corporation's duly authorized signing officers.

HO-A1. Agreement with St. Leonard's House (Peel) to Govern Funding Under the Federal National Housing Initiative, Supporting Communities Partnership Initiatives (SCPI) Program

RECOMMENDATION GC-27-2006:

That the Region's duly authorized signing officers be authorized to execute an Agreement and all other necessary documents required for the provision of a grant by way of an interest-free forgivable loan, to St. Leonard's House (Peel) for an amount up to $1,170,000.00, to be fully funded through the Federal National Housing Initiative, Supporting

Communities Partnership Initiatives Part 2 (SCPI) program funding, in accordance with the SCPI program requirements;

And further, that funding for the forgivable loan be provided from Capital Project 04-5020, Transitional or Supportive Housing Options.

HO-A2. Memorandums of Understanding with Peel Housing Corporation for Social Housing Properties

RECOMMENDATION GC-28-2006:

That the Region of Peel enter into a memorandum of understanding with Peel Housing Corporation for each social housing property constructed after October 2001;

And further, that all payments received by the Region of Peel in accordance with the terms of the memorandums of understanding be contributed to repaying the loan related to each social housing property;

And further, that after such time as the loan is retired, payments be contributed to the Housing New Development Reserve (R1160);

And further, that the internal loan for the Millbrook Place social housing property be increased by $150,000 to $15,250,000;

And further, that the required documents be executed by the Region's duly authorized signing officers of the Region of Peel.

That a copy of the joint report of the Commissioners of Planning, Public Works, Health, Corporate Services and Regional Solicitor, and the Medical Officer of Health dated January 19, 2006, titled, "Comments on the Clean Water Act (Bill 43)" be forwarded to the Ontario Ministry of the Environment (MOE) for their information and action, in response to the Environmental Bill of Rights (EBR) Postings AA05E0001 and RA05E0022;

And further, that the MOE be advised that the Region of Peel supports water source protection in principle and urges the MOE to revise the proposed Clean Water Act to address municipal concerns and allow municipalities to participate as full partners;

And further, that the comments to the MOE indicate that the Region of Peel is not prepared to fund source protection until implementation costs are known and a funding formula, acceptable to municipalities, is confirmed;

And further, that the subject report serve as the preliminary response of the Region of Peel to the Clean Water Act consultation;

And further, that a copy of the subject report be forwarded to the Town of Caledon; the Cities of Brampton and Mississauga; Credit Valley Conservation, Toronto and Region Conservation Authority, Central Lake Ontario Conservation Authority and the Association of Municipalities of Ontario, for their information.

RECOMMENDATION GC-31-2006:

That staff be authorized and directed to support Regional Official Plan Amendment (ROPA) Number 13 at the upcoming Ontario Municipal Board (OMB) hearing to deal with appeals made respecting Amendment Number 13 to the Region of Peel Official Plan for the purpose of defending the Amendment, which proposes an environmental mapping update of Schedule A - Core Areas of the Greenlands System in Peel.

RECOMMENDATION GC-32-2006:

That the user fees and charges proposed in Appendix II to the report of the Commissioner of Planning, dated January 16, 2006, titled "Amendments to User Fees and Charges", be approved;

And further, that the user fees and charges in Appendix II to the subject report take effect on April 1, 2006;

And further, that the necessary by-law be presented to Regional Council;

And further, that the Planning Department be directed to review the fees for the 2008 year, specifically to examine the ratio of revenue to expenditures and to better isolate the cost of processing draft plans of condominium;

And further, that a copy of the subject report be forwarded to the City of Mississauga, the City of Brampton and the Town of Caledon, for their information.
