C. APPROVAL OF AGENDA

RECOMMENDATION GC-190-2007:

That the agenda for the September 27, 2007, General Committee meeting be amended to include an oral update by Keith Ward, Commissioner of Human Services and General Manager, Peel Living on the current status of illegal immigrants from the United States in Peel’s emergency shelters, to be dealt with under Delegations/Presentations, as Item D2;

And further, that the agenda for the September 27, 2007, General Committee meeting be amended to include a Notice of Motion from Councillor Mullin regarding the resurfacing of roads by the Region of Peel subsequent to completing watermain/sanitary sewer works, to be dealt with under Other Business;

And further, that the agenda for the September 27, 2007, General Committee meeting be approved, as amended.

Carolyn Clubine, Director, Long Term Care, commended the work of the Long Term Care Facilities Medical Directors noting that staff at the facilities appreciate their dedication to long term care.

Councillor Groves noted that succession planning for the Medical Directors is a difficult issue and thanked Dr. Niedoba for bringing Dr. Fariha Khan to Malton Village for a trial period.

Councillor Adams requested that staff report to a future meeting with the options that are available to the Region of Peel as an employer, for penalizing employees facing allegations of abuse.

Regional Chair Kolb extended his appreciation to the Medical Directors for the good relationship they have developed with Regional staff and for their commitment to caring for Peel seniors.

Councillor Paterak requested that reports be prepared in similar formats to enable easier comparison of information.

D2. Keith Ward, Commissioner of Human Services and General Manager of Peel Living, Regarding Current Immigration Impacts on Peel Emergency Shelters

Keith Ward, Commissioner of Human Services and General Manager of Peel Living, advised that recent reports in the United States regarding an initiative by Homeland Security to deport illegal residents has resulted in a large number of immigrants coming to Canada from the United States to apply for refugee status from their home country.

Municipalities are required to provide housing and support to refugees while their applications are processed. As a result, the Region of Peel has had to house several people in hotels as the shelters are at full capacity.

Keith Ward advised that staff will continue to work with other municipalities to recover associated expenses from the Ministry of Community and Social Services.

ETP-A. INTERDEPARTMENTAL

ETP-A1. Provision of Transit Services in Caledon for Seniors Through Caledon Community Services, Application for Provincial Dedicated Gas Tax Fund

RECOMMENDATION GC-191-2007:

That subject to an agreement with the Town of Caledon for reimbursement of matching funding as set out below, an agreement with Caledon Community Services be entered into for the provision of the senior’s bus program on behalf of the Region of Peel;

And further, that Regional annual funding be capped at the additional Dedicated Gas Tax funding amounts;

And further, that the Region of Peel allocate the required matching 25 per cent municipal funding required under the provincial application process;

And further, that the Town of Caledon reimburse the Region of Peel for the original matching 25 per cent municipal funding;

And further, that staff be directed to forward all relevant documentation necessary to the Ministry of Transportation by October 1, 2007 to secure dedicated gas tax funding for 2007-2008.

ETP-B. ENVIRONMENT

ETP-B1. Beechwood Sewage Pumping Station, Sanitary Trunk Sewer, and Twin Forcemains, Capital Projects 06-2935 and 06-2405, Document Number 2007-449P - City of Mississauga, Ward 1

RECOMMENDATION GC-192-2007:

That the contract (Document 2007-449P) for engineering design services for the Beechwood sewage pumping station and sanitary sewers/twin forcemains be awarded to the engineering firm of Genivar Ontario Inc. in the estimated amounts of $694,948.60 and $389,794.65 (excluding applicable taxes), under Capital Projects 06-2935 and 06-2405 respectively, in accordance with Purchasing By-law 37-2007;

And further, that subject to approval of the 2008 Capital Budget, Document 2007-449P for contract administration services and inspection services for the Beechwood sewage pumping station and sanitary sewers/twin forcemains be awarded to the engineering firm of Genivar Ontario Inc. in the estimated amounts of $465,165.00 and $302,705.45 (excluding applicable taxes), under Capital Projects 06-2935 and 06-2405 respectively, in accordance with Purchasing By-law 37-2007.

ETP-B2. Transtor Container System for the Heart Lake Community Recycling Centre, Capital Project 07-6501 - City of Brampton, Ward 2

RECOMMENDATION GC-193-2007:

That the agreement between the Region of Peel and VQuip Inc. (supplier of the Transtor System manufactured by Haul-All Equipment Systems) be extended to include the supply and installation of the Transtor System at the Heart Lake Community Recycling Centre (CRC) at a cost of $1,669,430 (excluding applicable taxes);

And further, that staff negotiate directly with VQuip Inc. for the supply and installation of the Transtor System for all future CRCs.

ETP-B3. Supply and Installation of Ash Amended Asphalt at the Fewster and Caledon Community Recycling Centres, Capital Projects 99-6505 and 05-6475, Document Number 2007-633N - City of Mississauga, Ward 3 and Town of Caledon, Ward 1

RECOMMENDATION GC-194-2007:

That staff directly negotiate with Fermar Paving Limited to supply and install ash amended asphalt for the Fewster Community Recycling Centre (CRC), in an estimated amount of $850,000 (excluding applicable taxes) in accordance with Purchasing By-law 37-2007;

And further, that staff be authorized to issue payment to Fermar Paving Limited in the amount of $285,000 (excluding applicable taxes) for the supply and installation of ash amended asphalt for the completed works at the Caledon CRC.

ETP-B4. Pre-Purchase of Ultraviolet Light Equipment for the Lorne Park Water Treatment Facility, Capital Project 06-1906, Document Number 2007-331P - City of Mississauga, Ward 2

RECOMMENDATION GC-195-2007:

That the contract (Document 2007-331P) for the pre-purchase of ultraviolet light equipment for the Lorne Park Water Treatment Facility be awarded to Trojan Technologies Inc. at an estimated cost of $4,591,189 (excluding applicable taxes) under Capital Project 06-1906, in accordance with Purchasing By-law 37-2007.

ETP-B5. Water Efficiency Plan: Annual Update on 2006 Implemented Water Efficiency Measures, Capital Project 07-1585

RECOMMENDATION GC-196-2007:

That the Province of Ontario be requested to develop legislation restricting the sale and installation of non-efficient toilet models, designed to flush with 13 litres of water or more, in Ontario;

And further, that funding for the Industrial, Commercial and Institutional (ICI) Indoor Water Audit-Capacity Buy Back Program be financed from Capital Project 07-1585;

And further, that the report of the Commissioner of Environment, Transportation and Planning Services, dated September 5, 2007, titled “Water Efficiency Plan: Annual Update on 2006 Implemented Water Efficiency Measures, Capital Project 07-1585”, be forwarded to the Minister of Municipal Affairs and Housing, the Minister of the Environment, the Cities of Brampton and Mississauga and the Town of Caledon.

ETP-B6. Great Lakes and St. Lawrence Cities Initiative (GLSLCI) Water Conservation Framework

RECOMMENDATION GC-197-2007:

That the Region of Peel participate in the Great Lakes and St. Lawrence Cities Initiative (GLSLCI) Water Conservation Framework, as it directly relates to and highlights the previously enacted Region of Peel Water Efficiency Plan;

And further, that the GLSLCI Water Conservation Framework resolution, attached as Appendix I to the report of the Commissioner of Environment, Transportation and Planning Services, dated September 10, 2007, titled “Great Lakes and St. Lawrence Cities Initiative (GLSLCI) Water Conservation Framework,” be endorsed.

ETP-B7. Report of the Arterial Roads Review Ad Hoc Steering Committee (ARRASC-2007-1) meeting held on September 6, 2007

1. ELECTION OF CHAIR AND VICE-CHAIR

RECOMMENDATION ARRASC-1-2007:

That Councillor Paterak be appointed Chair of the Arterial Roads Review Ad hoc Steering Committee for the term ending September 6, 2009, or until a successor is appointed;

And further, that Councillor Sanderson be appointed Vice-Chair of the Arterial Roads Review Ad hoc Steering Committee for the term ending September 6, 2009, or until a successor is appointed.

RECOMMENDATION ARRASC-3-2007:

That staff revise the draft terms of reference for the Arterial Roads Review Ad hoc Steering Committee (ARRASC) to include the role of the Committee in Phase Two of the arterial roads review, beyond the development of the Terms of Reference;

And further, that members of the Committee be provided a draft of the ARRASC terms of reference staff report 10 days in advance of the next meeting of the Committee, in order to allow members of the Committee an opportunity to comment on the staff report prior to the report being printed with the agenda.

That staff provide a report to a future meeting outlining the concerns related to the inability of the equipment used by the Region of Peel to recycle various types of plastic materials and provide possible methods for increasing capture rates for plastics at the Material Recovery Facility (MRF);

RECOMMENDATION GC-200-2007:

Whereas, the Province of Ontario establishes Public Health Program Standards under the Health Protection and Promotion Act that each Board of Health is required to meet;

And whereas, rapid growth of approximately 34,000 residents per year and diverse demographic characteristics in the Region of Peel create pressures for additional public health services;

And whereas, Regional Council established a three-year plan to make service improvements to meet public health needs;

And whereas, the 2007 grant allocation from the Ontario Ministry of Health and Long-Term Care does not recognize growth and results in a funding shortfall of $8.8 million to meet current essential public health needs;

Therefore be it resolved, that the Regional Chair meet with the Ontario Minister of Health and Long-Term Care to advocate for equitable funding for public health;

And further, that a copy of this resolution be sent to the Acting Chief Medical Officer of Health, the Ontario Minister of Health Promotion, Peel area MPPs, and the Chairs of Durham, Halton and York Regions.

HS-B2. Best Start Additional Funding Plan

RECOMMENDATION GC-204-2007:

That the amended Best Start Budget Plan, as outlined in the report of the Commissioner of Human Services and General Manager, Peel Living, dated September 3, 2007, titled “Best Start Additional Funding Plan”, be approved;

And further, that the 2007 Best Start Program be increased by $5.9 million, as stated in the budget plan;

And further, that an in-year complement increase of 5.0 Full Time Equivalent (FTE) in 2007, be approved to reinstate the five of the nine FTE positions that were eliminated from the 2007 budget.

RECOMMENDATION GC-205-2007:

That the Commissioner of Human Services, and General Manager, Peel Living, be authorized to provide up to an amount not to exceed $1.2 million as additional subsidy for the capital work required at Northwood Park Co-operative Homes Inc., located at 195 Major William Sharpe Drive, City of Brampton, Ward 5;

And further, that the Commissioner of Human Services, and General Manager, Peel Living, be authorized to execute and deliver an Additional Subsidy Agreement (in the form of a non-interest bearing loan) including any other terms and conditions required for the payment and security of the additional subsidy, and other security and ancillary agreements and documentation deemed required, including a second mortgage on the Property, in a form satisfactory to the Regional Solicitor and the Chief Financial Officer;

And further, that the funding for the additional subsidy payment be provided from Capital Project 07-5040, Provider Capital Plan.

RECOMMENDATION GC-207-2007:

That The Regional Municipality of Peel enter into a an Easement Protocol Agreement with the Corporation of the City of Mississauga with respect to easements as outlined in Appendix I to the report of the Commissioner of Employee and Business Services and the Commissioner of Environment, Transportation and Planning Services, dated September 7, 2007 titled “Proposed Easement Protocol Agreement Between The Regional Municipality of Peel and The Corporation of the City of Mississauga, City of Mississauga Wards 1, 2, 3, 4, 5, 6, 7, 8, 9, 10 and 11.

MA-B. CHIEF FINANCIAL OFFICER

A motion was placed by Councillor Gibson to refer Items Related to Management – Item MA-B1 to the October 4, 2007 Regional Council meeting.

The motion was voted on and lost by a majority vote against referral of the item.

F1. Notice of Motion by Councillor Mullin regarding the Resurfacing of Roads by the Region of Peel Subsequent to Completing Watermain/Sanitary Sewer Works

Whereas, currently in 2007, the replacement of water and sanitary sewer infrastructure will be required on 35 local residential roads within the City of Mississauga, of which only eight roads will receive full road resurfacing due to the poor state of the roadway prior to the water or sanitary sewer replacement work;

And whereas, the City of Mississauga pays for the full resurfacing of roads in cases where the state of the road was poor prior to the commencement of work by the Region;

And whereas, roads which are not fully resurfaced following the replacement of water and sanitary sewer infrastructure by the Region are only resurfaced in the portion of the road surface that must be replaced due to the work;

And whereas, many residents are upset that roads currently in a good state of repair are patched and paved with two colours of asphalt, affecting the aesthetics of residential streets;

And whereas, the Region of Peel is increasing the number of watermain and sanitary sewer replacements which will increase the number of roads that will not be fully resurfaced after the water or sanitary sewer replacement work is completed;

Therefore be it resolved, that Regional staff report back to Regional Council on the financial implications of the implementation of a program in which the Region would fully resurface the entire residential roadway when undertaking watermain or sanitary sewer replacements where the road is in a good state of repair and not scheduled for resurfacing by the area municipality prior to undertaking the work, by placing a thin layer of asphalt over the entire roadway.

F2. Update regarding the Peel Regional Police Job Action (Oral)

Received

Councillor McCallion requested the Regional Chair to update General Committee on the job action undertaken by the Peel Regional Police.

Regional Chair Kolb advised that the Peel Police Services Board was surprised and disappointed with the position taken by the Police Association. The Board is responding to comments made by the Association and is working to schedule conciliation meetings. Regional Chair Kolb committed to keeping Members of Regional Council informed of the progress.

F3. Odour Problems - Lakeview Wastewater Treatment Facility (Oral)

Received

Councillor Mullin noted that residents along the Mississauga Lakeshore have been experiencing odour problems from the Lakeview Wastewater Treatment Facility and requested the Commissioner of Environment, Transportation and Planning Services to report to a future meeting with a public awareness plan to assist residents to mitigate the odour.
