THE REGIONAL MUNICIPALITY OF PEEL

BY-LAW NUMBER 228-81

A BY-LAW TO AUTHORIZE AN OFFER OF COMPENSATION WITH RESPECT TO THE EXPROPRIATION OF LANDS IN THE REGIONAL MUNICIPALITY OF PEEL (FORMERLY IN THE COUNTY OF PEEL).

WHEREAS by Plan of Expropriation registered on the 23rd day of October, 1981, in the Registry Office for the Registry Division of Peel (No. 43) the lands and premises described in Schedule "A" hereto were expropriated;

AND WHEREAS Section 25 of the Expropriations Act, R.S.O. 1970 requires that the expropriating authority shall within three months after the registration of the Plan of Expropriation, serve upon each registered owner an offer of an amount in full compensation for his interest and an offer for immediate payment of One Hundred Percent (10096) of the amount of the market value of the lands as estimated by the expropriating authority;

AND WHEREAS the registered owner is as follows:

Christine Caroline Chmiel

AND WHEREAS the Regional Municipality of Peel has obtained a report appraising the market value of the lands taken and damages for injurious affection;

AND WHEREAS the Council of the Region of Peel has by resolution on the 17th day of December, 1981, authorized an Offer of Compensation;

NOW THEREFORE, the Council of the Regional Municipality of Peel enacts as follows:

1. That the registered owner of the lands herein be offered in full compensation for all her interests in the lands taken the sum of $9,400.00 such amount to be apportioned as follows:

Christine Caroline Chmiel - $9,400.00

2. That the registered owner of the lands herein be offered immediate payment of $9,400.00 being 100% of the amount of the market value of the lands herein as estimated by the expropriating authority, such amount to be apportioned:

Christine Caroline Chmiel - $9,400.00

3. That the Chairman and the Clerk be and the same are hereby authorized to execute the required offer to the registered owner under the seal of the Regional Municipality of Peel.

4. That the aforesaid offer be served upon the registered owner of the lands herein together with a copy of the appraisal report hereinbefore referred to and a statement of the compensation being offered.
