THE REGIONAL MUNICIPALITY OF PEEL

BY-LAW NUMBER 72-94

A by-law to amend By-law Number 66-86, as amended, entitled "A by-law to authorize the
construction of a watermain on Station Street, Cardwell Street, Main Street, King Street,
Victoria Street, Agnes Street, Queen Street, Margaret Street, Thomas Street, Amelia Street,
Ann Street, Nicholas Street, Old Queen Street, James Street, John Street and Credit Street in
the Village of Alton, Town of Caledon at a total estimated cost of $425,000.00."



WHEREAS the Council of the Regional Corporation has by Resolution 86-299-15 on the 20th May, 1986 authorized the construction of a watermain project in the village of Alton, in the Town of Caledon, under Project 86-1010 pursuant to section 80 of the Regional Municipality of Peel Act, R.S.O. 1980, Chapter 440, as amended, and section 218 of the Municipal Act, R.S.O. 1980, Chapter 302, as amended;

AND WHEREAS the Council of the Regional Corporation deems it desirable to impose a waterworks rate on the owners or occupants of certain lands in the area municipality of the Town of Caledon, pursuant to section 218 of the Municipal Act, R.S.O. 1980, Chapter 302, as amended;

AND WHEREAS By-law Number 66-86 was enacted to authorize the construction in accordance with Resolution 86-299-15;

AND WHEREAS the Council of the Regional Corporation has by resolution on the 14th July, 1994 authorized an amendment to By-law Number 66-86 as amended;

NOW THEREFORE the Council of the Regional Corporation enacts as follows:

1.That subsection 5.(e) of By-law Number 66-86 as amended by By-law Number 126-86, be repealed and the following be substituted therefor:

"5.(e)That the amount of $97,079.32, being 6.62% of the total cost of the works, shall be recovered by means of a waterworks rate assessed against the properties abutting the works, as set out in Schedule "A" attached hereto, in the following manner:

(i)property having 61 metres of frontage or less shall be assessed at a rate of $21.00 per metre of assessable frontage, which rate and interest at 10% for fifteen (15) years, shall be payable in fifteen (15) equal instalments of $2.76 per metre of assessable frontage;

(ii)property having more than 61 metres of frontage if used for agricultural purposes or residences in connection with such agricultural purposes and as long as they remain used for such purposes, shall be assessed a charge of $1,281.00 which charge with interest thereon at 10% for fifteen (15) years shall be payable in fifteen (15) equal instalments of $168.36; and

(iii)property having more than 61 metres of frontage, which is not used for agricultural purposes or residences in connection with such agricultural purposes, shall be assessed at a rate of $21.00 per metre of assessable frontage, which rate and interest at 10% thereon for fifteen (15) years shall be paid in fifteen (15) equal instalments of $2.76 per meter of assessable frontage."

2. That By-law Number 66-86 be amended by adding the following:

"5.(f)Each property abutting the works, as set out in Schedule "A" attached hereto, shall be assessed connection charges at a rate of $150.00 per connection, and the said rate with interest thereon at 10% per annum for fifteen (15) years shall be payable in fifteen (15) annual instalments of $19.72 per connection.

(g)The said waterworks rate shall come into force and take effect on the date of the passing of this by-law and shall continue on an annual basis for a period of fifteen (15) years thereafter. The due date for payment of the waterworks rate shall be sixty (60) days from the date of invoice for each payment.

(h)If any of the properties affected by this by-law are severed before the end of the fifteen (15) year period referred to herein, the newly created lot shall also be subject to the waterworks rate established in this by-law as if the lot was in existence on the date this by-law is passed."
