THE REGIONAL MUNICIPALITY OF PEEL
 
BY-LAW NUMBER 25-2001
 
A by-law to repeal and replace By-law 16-98 to designate persons to give approvals for traffic control signals on Regional roads; to prescribe the manner in which traffic control signals shall be operated; and to repeal By-law Number 131-74.

 

WHEREAS the Highway Traffic Act, R.S.O. 1990, c. H.8, s. 144 (31), as amended, provides that no traffic control signal system or traffic control signal used in conjunction with a traffic control signal system shall be erected or installed except in accordance with an approval obtained from a person designated to give such approvals by the municipality or other authority that has jurisdiction over the highway or the intersection;

AND WHEREAS the Regional Municipalities Act, R.S.O 1990, c. R.8, s. 34(8), as amended, provides that all signal-light traffic control devices heretofore or hereafter erected on a highway under the jurisdiction and control of an area municipality shall be operated, or erected and operated, in the manner prescribed by by-law of the Regional Council, and the Regional Council may delegate any of its powers in respect of the operation of such devices to an officer of the Regional Corporation designated in the by-law;

AND WHEREAS the Council of the Regional Corporation on the 12th day of September, 1974 passed By-law 131-74 to prescribe the manner in which signal light traffic control devices shall be erected, operated and approved;

AND WHEREAS the Council of the Regional Corporation on the 12th day of March, 1998, passed By-law 16-98 to repeal and replace By-law 131-74 as the by-law to designate persons to give approvals for traffic control signals on Regional roads and to prescribe the manner in which the traffic control signals shall be operated;

AND WHEREAS the Council of the Regional Corporation has by Resolution 2001-259 adopted on the 29th day of March, 2001 authorized the enactment of a by-law to designate persons to give approvals for traffic control signals on Regional roads;

NOW THEREFORE the Council of the Regional Municipality of Peel enacts as follows:

1. The Director, Engineering and Construction, or the Manager, Traffic and Transportation Engineering, or the Supervisor, Traffic Signals and Systems are hereby designated to approve the erection or installation of all traffic control device used in conjunction with a traffic control signal system hereafter erected or installed on a highway or intersection under the jurisdiction of the Regional Municipality of Peel.

2. Traffic control signals on a highway or intersection under the jurisdiction of the Regional Municipality of Peel or under the jurisdiction of an area municipality within the Regional Municipality of Peel shall be operated in accordance with the Highway Traffic Act and Regulations, both as amended, and the Ontario Traffic Manual, as amended from time to time.

3. By-law 16-98 is repealed.

4. This By-law takes effect on May 10, 2001.
