A by-law to provide for the Regional Corporation's consent to permit an encroachment onto parts of Regional Road 1 (Mississauga Road) and Regional Road 14 (Mayfield Road) in the Town of Caledon.



A by-law to provide for the Regional Corporation's consent to permit an encroachment onto parts of Regional Road 1 (Mississauga Road) and Regional Road 14 (Mayfield Road) in the Town of Caledon.


WHEREAS Pioneer Hi-Bred Production Ltd., the owner of the lands and premises described as Part of Lot 18, Concession 4, West of Hurontario Street, Town of Caledon, Regional Municipality of Peel (formerly in the Township of Chinguacousy, County of Peel) and more particularly described as Parts 1 and 2 on Reference Plan 43R-11914, save and except Parts 1 and 2 on Reference Plan 43R-22435 and Parts 1, 2, 3, 4, 5, and 6 on Reference Plan 43R-25560; and municipally known as 12111 Mississauga Road, has requested permission to maintain and use certain structures or improvements upon the public highway;

AND WHEREAS pursuant to, Section 308 (3) of the Municipal Act, R.S.O. 1990, Chapter M.45, as amended, the Regional Corporation may permit encroachments onto Regional roads;

AND WHEREAS the Council of the Regional Corporation has by resolution passed on the 6th day of December, 2001 authorized the enactment of a by-law authorizing the said encroachment;

NOW THEREFORE, the Council of the Regional Corporation enacts as follows:

1. Pioneer Hi-Bred Production Ltd. is hereby authorized to maintain certain encroachments upon the public highway known as Regional Road 1 (Mississauga Road) and Regional Road 14 (Mayfield Road), as described herein and in accordance with the terms and conditions contained in the Encroachment Agreement dated the 22nd day of October, 2001, between the Regional Municipality of Peel and Pioneer Hi-Bred Production Ltd., with respect to Part of Lot 18, Concession 4, West of Hurontario Street, Town of Caledon, Regional Municipality of Peel (formerly in the Township of Chinguacousy, County of Peel) and more particularly described as Parts 1 and 2 on Reference Plan 43R-11914, save and except Parts 1 and 2 on Reference Plan 43R-22435 and Parts 1, 2, 3, 4, 5, and 6 on Reference Plan 43R-25560; and municipally known as 12111 Mississauga Road.

2. That Schedule "A" attached to this by-law is included and shall be considered part of this By-law.

3. That the Encroachment Agreement be executed on behalf of the Regional Corporation by the Regional Solicitor and the Regional Clerk and the corporate seal affixed thereto.
