WHEREAS the Council of the Regional Municipality ("Regional Corporation") on December 12, 2002, passed By-Law 66-2002, being an omnibus user fee by-law to impose fees for services and activities provided by the Regional Corporation; and

WHEREAS Ontario Regulation 244/02 under the Municipal Act, 2001, imposes enhanced public notification requirements in the case of waste management, water and wastewater system charges and fees; and

WHEREAS By-Law 66-2002 includes waste management system fees, and charges provided by the Regional Corporation for the use of its property;

AND WHEREAS the Council of the Regional Corporation has by resolution adopted on February 12, 2004, authorized a stand alone by-law to establish waste management system fees and charges;

AND WHEREAS the Council of the Regional Corporation has by resolution adopted on February 12, 2004, authorized that By-Law 66-2002 be amended to delete the waste management system fees and charges contained therein which amendment is being effected pursuant to a by-law separate from the by-law herein;

NOW THEREFORE, the Council of the Regional Corporation enacts as follows:

1. The Waste Management System Fees and Charges outlined in the attached Schedule A and forming part of this by-law are hereby adopted, enacted and imposed.

2. That the tariff of fees and charges respecting waste management on the day immediately prior to the day this by-law comes into effect, shall continue to apply to fees and charges which became payable prior to the date upon which this by-law comes into effect.

3. This By-Law may be referred to as the "Waste Management System Fees and Charges By-Law, 2004."

4. This By-law takes effect on the day that it is passed.
